An interesting question was posed today in the Learning Centre / RedBubble 101 Forum … Are URL’s protected by copyright?
Its a good question, and certainly different from most of the questions I get asked about copyright.

Usually we are concerned with what is covered by copyright as opposed to what is not, so today I am going to cover the topic of what things are not covered by copyright and how that applies to URLs/Domain Names.

Like “transformation”, Parody is also widely misunderstood when it comes to copyright infringement.

A large part of this misunderstanding comes from a confusion caused by the usage of the word “parody” itself.

To most of us, parody means to make fun of something. But in a legal sense that is closer to “satire”, and satire as you will shortly see has very little defence against copyright infringement.

I have had several discussions recently with members who have been struggling to understand the concept of “transformation” when it comes to copyright exemption.

The general understanding of transformation, amongst many RB members, goes something like this:

“If I change or modify an image then Fair Use law says that I am not infringing copyright because it is ‘transformative’”

The Pokemon Company recently sued a cafe worker for planning to organise a Pokemon-themed party to co-incide with the start of the PAX Gaming Convention in Seattle.


From the news article:

As soon as Ramar Larkin Jones got wind that lawyers from The Pokémon Company objected to the Pokemon-themed party he had planned in August, he shut it down.

But that’s far from the end of it. Pokémon’s lawyers aren’t letting go—they refused to dismiss the case against Jones unless he coughs up $4,000 by mid-November. Jones, who described his plight to Geekwire, says he just hasn’t got the money.

THE FAIR USE DOCTRINE EXPLAINED

The AVVO Website has many great resources relating to copyright.…

AVVO is a website designed to help bring people and lawyers together.

There is a great 5 minute video explaining the “Fair Use Doctrine” (click on the link above!) While some of the elements of this video refer to specific US Law (Freedom of Speech), the basics are applicable to everyone no matter what country they are from.

To qualify for Fair Use / Fair Dealing then the use of a copyrighted material must be shown to fall into one of these areas:

- Criticism,
- Comment,
- News reporting,
- Teaching (including multiple copies for classroom use),
- Scholarship or research.

As well, how the copyrighted material is used forms part of the determination (this is known as the “Four Factor Test”):

The AVVO WEBSITE posted this very informative discussion about copyright entitled Can I legally sell my own paintings of Disney characters if I put the Disney “D” in the bottom corner?

The person posting the question wanted to know if it is ok to create your own version of a copyrighted image (in this case Disney property) and then sell it so long as they credit Disney as the creators…

Several Intellectual Property Lawyers responded to this question, and their answers were unequivocal… you can not do this without a Licence.

Here are some of the things they had to say:
