Bullshit! And this is why. I realised whilst reading other peoples comments that some people have been dissuaded from taking photos around interesting industrial locations. After all you must be a terrorist if you are taking a photo of a refinery, right! Thought I’d share some of my experiences on the subject as I am very often in these kinds of situations. My day job is photographing cars for magazines. I often do this in industrial locations and sometimes near sensitive installations such as refineries, ports, airports, you name it. I’ve been accosted by security guards, customs agents, police, ignorant old farts, you name it. I’m sure someone has already reported me to ASIO. I’m not a lawyer so don’t try to use me as an excuse if you end up in jail, do your own legal research, consult a lawyer if you think you need to, but this is the information I have obtained from both State and Federal Police when I’ve called to question the legality of such photography. Basically, there are no laws which prevent you photographing any property from a public place! Private properties such as shopping centres, subways, airports etc are a completely different story whilst within the property. The property owner sets the rules and you must abide or leave. But if you are outside the private property and on public land then shoot away. There can be local council By-Laws preventing photography, such as on some beaches, so it is worth asking the question if you think it might be relevant. However, any Police officer can do just about anything they like to you should they have good reason to suspect you of Terrorist activity. They can confiscate your camera, detain and question you. My solution to this is to have some forms of identification or samples of my work, in a small compact Folio, which can be shown to quickly convince them of my real intentions and identity. I have a Canon CPS card with my photo on it and business cards, or you could join one of the professional photographic associations (if you are eligible) some of which now offer membership cards for this very reason. There’s heaps of good information here on the legality of photography. It’s worth reading. / http://www.4020.net/words/photorights.php Having said that, you can’t then just do anything you like with the images because of trade mark and copyright issues with buildings and company logos, but that’s a whole different issue anyway. Just being allowed to take the photo doesn’t mean you can do whatever you like with it. My suggestion is that if you are going to be shooting in really questionable places AND you think you might have trouble with security, then try to contact the security people first and tell them who you are and what you are doing. DO NOT ASK FOR THEIR PERMISSION, you don’t need it! Just offer them the courtesy of letting them know who you are and what you are doing so that they don’t have to worry about you. Shell, for example, is a bit touchy about this kind of thing. I always call them and tell them of my intentions to shoot around their refineries. They appreciate it and we both play nicely. Same thing at airports such as Moorabin or Essendon. It works. Know your rights and don’t let the ignorant push you around. Of course never let things get out of hand. I can honestly say that I would be the first to call the police should a security guard get heavy handed with me. Not that it’s ever happened, and hopefully it never will. JJ

I thought this was soooo quirky it couldn’t go unspotted… Australian’s have been hearing about this all week, now the President is gone (oh woe!). In the wake of yesterday’s sadness, I wish to highlight to the world how secure we really are! Even with 10s of 1000s of dollars, tch tch… The Chaser is a program aired on the ABC (Australia’s Independent Government Broadcaster or something). They specialize in making a scene by challenging political thinking and basically making public asses of themselves through ‘comedy’. I am not a regular viewer of the program, and they have their lovers and haters. But whether you love ‘em or hate ‘em, I can’t deny the potency of this example… It’s a wonder they didn’t get killed, and I am glad they didn’t, but they were antagonising the security for the entire time… How did they not see this coming… Good work Chaser… you proved something to me that I already thought anyway… Below is a transcript from the ABC News website and a few other links for those interested… Mixed response to Chaser’s APEC antics THE ABC has received 266 complaints about the Chaser team’s breaching of security at the APEC forum in Sydney last week. The national broadcaster has also had 177 phone calls, emails or letters of “appreciation” for the stunt in which the Chaser team were charged by police with entering a restricted zone after driving a mock motorcade bearing Canadian flags through two security checkpoints. The Chaser team maintained they had no intention of entering the restricted “red” zone. Once inside it, they turned around voluntarily and were approached by police only after Chaser performer Chas Licciardello got out of the car, dressed as Osama bin Laden. An ABC spokeswoman, Lesna Thomas, said: “People generally call to complain. You usually don’t hear from them when they like a show, so the number of appreciative calls is high.” She said the ABC had not had any complaints about the Chaser prank from politicians or police. Talkback callers around the country supported the Chaser by a four-to-one margin.Media Monitors figures showed the Chaser stunt accounted for more than a third of the 420 calls on APEC between last Thursday and Sunday. On 2UE in Sydney one caller thanked the Chaser team for highlighting a major hole in the APEC security, while another on Melbourne’s 3AW said the stunt was funny and criticised the Government for spending more than $170 million on security for APEC instead of on hospitals and public transport. On the ABC in Sydney another caller called the prank hilarious and said she did not think it was irresponsible. But one caller, on 3AW, said if US President George Bush had been in his hotel, the Chaser team could all have been killed. He described them as lunatics. Late yesterday, the day before the sixth anniversary of the September 11 terrorist attacks, the Chaser team released on the community networking site, My Space, a spoof address from Osama bin Laden. The team have renamed their program tomorrow night The Chaser’s War on APEC. http://www.news.com.au/entertainment/story/0,23663,22345122-10229,00.html / http://www.smh.com.au/articles/2007/09/06/1188783378804.html / http://www.smh.com.au/articles/2007/09/07/1188783496428.html

I am impressed that there is a program now in NZ to help artists through their social security system. It may not be the best, or not developed enough yet, but at least there is one. I have been reading peoples comments on this program and well, some are not happy, but living in Brisbane Australia, knowing the Centrelink system, I would be grateful if I was them. Here is the link to the winz site that talks about Pace…. wouldn’t it be fantastic if we could have something like this in Australia, or even other countries…. http://www.workandincome.govt.nz/manuals-and-procedures/employment_and_training/programmes_and_services/pathways_to_arts_and_cultural_employment/pace.htm Make sure there are no gaps, it just won’t fit on the page :)

Why is education so important? For us, the very, very select few who actually study social ecology and in depth, analytical political science, we’ve come across the scariest statistic for now and the future. Individuals in US, ages 22-110 (or death), only 23% have completed a 4 year degree or more. The Bachelors degree is considered the new high school diploma. This is calculated by advancement and progression. As we progress into the future, only 23% of individuals immediately have graduated “The New High School.” We wonder why Asia is becoming stronger and our jobs are going elsewhere. Our jobs are taken by other because they are qualified. Yes in some areas they do it for less, but overall, they are the ones qualified and working hard to achieve their self actualization. We’re in trouble because the internet generation starts to blossom, fewer kids are attending school because of the recently developed shortening attention span. The same attention span reality television and internet gaming has captured. I actually have a hard time going to sleep at night because all I want to do is change this. We can have both, but first we have to get everyone away from the screen and off the streets and into the classroom. We complain about how poor people are getting and there are no jobs, well if we would finish what we started with our education, there wouldn’t be a problem, we would be actualized and we wouldn’t have to create jobs by warfare. We’d actually create peaceful technological jobs, just like in South Korea and Japan.

  • Orphan Works Bill Put on Hold

Hi everyone to follow is a copy of an email I received yesterday….thought you all might be interested: / ___ / FROM THE ILLUSTRATORS’ PARTNERSHIP / Senate Orphan Works Bill Put “on Hold” We’ve just received word that the Senate bill has been put “on hold.” In fact, there appear to be multiple holds on it. Senators who “hold” hotlined bills do not have to identify themselves nor give their reasons for holding it. Holds are temporary. We don’t know how many of you contacted your Senators on such short notice this afternoon, but many, many thanks to all of you who responded so rapidly. / / Most people are unaware of the process called hotlining. In the past it was used to pass non-controversial legislation, but increasingly, it’s being used to pass bills whose sponsors don’t want to see debate. An excellent article in Roll Call explains the process. Here’s an excerpt: Senate conservatives are upset that the leaders of both parties in the chamber have in recent years increasingly used a practice known as “hotlining” bills – previously used to quickly move noncontroversial bills or simple procedural motions – to pass complex and often costly legislation, in some cases with little or no public debate. The increase was particularly noticeable just before the August recess, when leaders hotlined more than 150 bills, totaling millions of dollars in new spending, in a period of less than a week. The practice has led to complaints from Members and watchdog groups alike that lawmakers are essentially signing off on legislation neither they nor their staff have ever read… In order for a bill to be hotlined, the Senate Majority Leader and Minority Leader must agree to pass it by unanimous consent, without a roll-call vote. The two leaders then inform Members of this agreement using special hotlines installed in each office and give Members a specified amount of time to object – in some cases as little as 15 minutes. If no objection is registered, the bill is passed. - From ‘Hotlined’ Bills Spark Concern / By John Stanton, Roll Call Staff / September 17, 2007 / To read the full article, go to: http://tinyurl.com/3p8×2u This is the second time the Senate Orphan Works bill has been hotlined this summer. The previous hotline came on June 5, the same week artists descended on Washington to urge lawmakers to oppose this controversial bill. The bill was put on hold that time too. Since bills can be hotlined without prior notice, we’ll all have to stay vigilant throughout the rest of this legislative session. Thanks again to all of you who responded so quickly. Over 60 organizations, representing more than 250,000 creators, are united in opposing these bills in their current form. Illustrators, photographers, fine artists, songwriters, musicians, and countless licensing firms all believe this bill will harm their small businesses. / Read the list: http://www.illustratorspartnership.org/01_topics/article.php?searchterm=00273

Alot of my surfing pictures, are taken locally here…..so i need some help if at all possibe please read and check website to help, proudly all the photo’s on the site are my own www.saveoilies.org The latest expansion to the Port of Port Kembla comes at a huge expense tothe local community whom will be locked out of the foreshore area on the northern side of the harbour forever. A range of recreational users including surfers, fisherman, swimmers, walkers, photographers, dogwalkers, and cyclists has been enjoying access to this area for over 30 years. The surf break is known to many as “Oilies”. On 1 November 2008 the current proposal will see security gates erected outside the Sydney Water Wollongong Sewerage Treatment Plant on Port Kembla Road, Wollongong locking out all non-business related traffic to the Port and also the foreshore area. The proposed closure is based on dubious security grounds and has involved no public consultation. Whilst there is recognition of the Ports need for security and the important role that the Port plays in economic terms for the Illawarra and the broader national economy, opportunities exist to secure the facility whilst still permitting the community access to the foreshore area. The proposed closure is contrary to the State Government Policy of maintaining community access to foreshore areas and when the gates go in this part of the foreshore will be lost to the community forever. This area has thousands of users whom will be displaced and an IRIS survey conducted on behalf of the Port Kembla Coal Terminal found that on an average summer weekend there are 165 vehicle trips per day to the foreshore in this area and this is without any promotion. The State Governments policy on urban consolidation will see increased residential densities throughout the Illawarra with a particular emphasis on more multistorey residential developments going in around the Wollongong City centre. This increase in population density will place more pressure on the finite resources of the foreshore areas. The community needs more foreshore area for recreation not less. The latest State and Local Government initiative with the Blue Mile needs to be extended to go the extra mile and secure foreshore access for the community in perpetuity. It is also incumbent upon industry to be good neighbours and respond to the needs of the community rather than being solely motivated by self-interest. A simple long term solution exists to ensure that this foreshore area is retained in public ownership with free access to all. / What needs to happen is that the Port boundary (a line on a piece of paper) needs to be changed to exclude the foreshore area in this locality and the publically owned private road needs to be dedicated back to Council as a public road. The proposed security gates could moved further south along Port Kembla Road ensuring security to the Port is maintained but not at the expense of public access to the foreshore. The land in question is already in public ownership as it is owned by the State Government whom control the Port Kembla Port Authority. Come on community – now is the time to put pressure on our State politicians to show some leadership and get community access to the foreshore area secured for generations. We feel that this matter needs to be brought to the attention of the wider community before this important community asset is lost forever. Has anyone experienced problems taking photographs in London ? I had a recent run-in with an over-zealous railway employee at Charing Cross. He asked me to stop photographing, which I did, but he also demanded I delete the images I had just taken. I knew that he had no legal authority to demand this and I politely pointed this out. He got all hot under the collar and called a policeman, with whom I had a very pleasant chat and I kept my images. I work for a central government department and I fully understand the security issues at stake here… but I still think there is an unreasonable amount of paranoia being whipped up against photographers. Have you been challenged anywhere ? Do you know what your rights are as a photographer on the streets of London ? Rose

Firstly, had a great trip in Berlin took looots of photos (managed to fill my two memory cards- ok one isn’t great) in three days, so have lots to upload. I will stagger them, and tidy my portfolio at the same time to prevent over loading y’all, and my uploads drying out as I get flushed with uni work! Also had a bit of an idea for another writing, with a shortish story- though currently with no end, it could be any length- already on paper and computer! Secondly, I realise this may be a silly way of raising this issue, but internet paypal accounts…for or against? I’m not sure I like the idea of giving all my information to a site for permanenet memory- here I am hoping that my cards are only for the purchases and ‘short time’ keeping-and I try not to shop online, though do occassionaly venture in to it…what are the votes? I have no sales, so that is not currently an issue, and it would seem pointless to start an account for somethin g that isn’t going to happen…but I can hope, and perhaps it will make buying things easier…? Hmmm…wondering if anyone can suggest/ comment?

Many consider gardening to be a pleasant hobby. Watching something you plant rise out of the ground is a wonderful thing, especially when the result is a gorgeous flower that will have neighbors swooning. Take the rose, for example. Seen in varieties of red, yellow, white, and pink, roses have been recognized for thousands of years as one of the most beautiful flowers on the planet. For our purposes, they’re even more attractive. Rose stems sport extremely sharp barbs that draw blood at the slightest prick. Creative gardeners with home security / in mind plant these right under low-lying windows to prevent intrusion. The result is a visually appealing addition to your home’s décor that boosts your home security system / and safety at the same time. Truly a win-win situation.

It looks like this summer could have the necessary ingredients for the perfect storm that will send crime rates soaring through the roof. First off, it looks like criminal activity is trending upward along with the Recession, as desperate people begin to take desperate measures. Though concrete statistics have yet to be determined, police chiefs around the country report a noticeable increase in reported crimes. Most are recommending home security systems as the most potent method available to citizens for protecting against this surge. People tend to spend more time outside of their own homes, leading to more invasions. Extreme heat also leads to a general loss of self-control and restraint. Finally, don’t forget that kids are out of school, unsupervised, and looking to cause trouble. Having a home security system really does help ease a little bit of my fears this summer. Please protect your family and loved ones and educate your self this summer. Get a reliable home alarm system you can count on to keep you and your family safe.

There are a couple of basic factors to keep in mind when determining which home security / provider meets the minimum standards of professionalism and quality of service. First among them would have to be experience: there is just no substituting experience, ever! Companies that which have been operating in the field for well over a century, have got the know-how to provide customers with the comfort and safety they want and need—all thanks to lessons learned the hard way. Second comes the issue of resources: this can be thought of as infrastructure on the one hand and trained personnel on the other. A quality home security operation simply cannot be based out of a dinky office space in just one or two cities, with the same means of communication as any ordinary company/individual would have. To the contrary, a quality security company is going to have upwards of four central offices, known as monitoring centers, that are strategically spread throughout the nation (and the continent) to prevent the concentration of resources and media, with all the risks that that entails. Additionally, with regards to trained personnel, a trustworthy home security operation is going to have its own, salaried personnel; not a couple of jokers contracted out by a no-name company that doesn’t even specialize in the security field! Finally, be sure to check with credible, independent sources such as the Better Business Bureau to see what sort of histories certain providers have. Fewer complaints and even fewer unresolved complaints are always a good sign—so act on it.
