    Disclaimer: This is not legal advice or even professional advice. This is some stuff I’ve learned along this funny little thing called life and may not apply in any way to your current situation. At worst, it’s my opinion, at best it’s some ideas for you to think about. If you need real proper advice, go see your solicitor. I’m of the opinion that photography should make me money, not cost me money. So far, I have been successful is making more from a photograph than it took me to create. Here is my list of not so secret tips and advice on covering your arse and saving your cash. When To Pay There are times where spending your hard earned money is the right choice. For example to obtain goods or services you can not find for less (or free) elsewhere. Or when you have done all the maths yourself and you feel you are buying into a good deal. But there are also some pit falls to watch out for. Art Direction, Ideas and Intellectual Property My rule of thumb, if I am paying to shoot, I should have full rights to everything I take. No ifs buts or maybes about it. If you shoot a commercial, the art direction team put together a shoot and then hire a photographer to take photos of what they and the crew have created. They pay for lighting design, they pay the models, they pay the hair stylist, they pay the guy who makes the coffees- and they pay the photographer. Some businesses operate under a similar model but suck money out of photographers in the process. As part of a ‘workshop’ or ‘event’, several photographers rock up with their cameras and take photos of a scene. Often they have little or no control of the setup, can’t communicate properly with the models and will walk out of it with similar images to everyone else who attended! In the worst cases they have restricted rights regarding how they use their images. So is essence, they have paid for something that out in the real world, would be making them money. Sorry if it sounds confusing, the concept completely baffles me. When you are shooting someone else’s ideas and have restricted publishing rights or have little influence over the set up, posing, lighting or set design, (in my opinion) you should be getting paid by them. After all, you are doing them a favor by taking images of their creative work. Classes or Tuition Wanting to improve you skills and knowledge is a great thing. And there are numerous classes, mentors and workshops available for you to choose from. If you are going to pay to attend these, make sure you are getting what you pay for. Before you hand over any cash there are a few details that you should have to help make your decision. Class Size: The more people attending, the cheaper the class should be. If there is a practical component, I usually wont accept a class bigger than 10-12 / Location & Time: no point signing up for an ‘on location’ workshop only to find it is out of your way. Also as a safety issue, you should always be able to tell a trusted person exactly where and when you will be shooting. / The Teacher: You should be able to find and contact the person facilitating the class to verify their experience and ask questions. It not always convenient for a facilitator to take calls from a whole class, but you should be able to send them an email and get a reply without going through a middle man. / Contracts: Ask if you will need to sign any contracts and insist upon receiving them before paying. / What do you get: do you get class notes to take home? Exactly what does the course entail? What can you hope to know and have learned at the end of the course? Contracts These are a great way to waste your money. They also happen to be very important. First and foremost contracts exists to make people money or stop people from making money. So before signing anything, read it a few times and make sure you are aware of what your actions are costing you. If you need to get images approved before sale or publication, you could be agreeing to never publishing or selling any images taken if none are ‘approved.’ It is completely reasonable to request changes to a contract or write your own and offer it instead. Don’t sign away potential income! You should always be able to take a contract away and show it to other people for advice before signing it, and especially before paying for anything. If you are not given this opportunity, my advice is to avoid it with a ten foot pole. And then there are the bazillion poorly written contracts that mean very little or nothing at all.     If you are an artist or photographer in the United States PLEASE TAKE HEED: you may loose all rights to your work very soon. A bill is before Congress which will essentially make all works of art ever created orphaned works and send them to the public domain. Essentially what this bill will do is force artists and photographers to pay fees to commercial registry companies to register a copyright on every single work you have ever created or ever will create. The current law protects your copyright without registration. Registration with the United States Copyright Office merely sets statutory damages in the event of copyright infringement. The new law will REQUIRE registration NOT WITH THE COPYRIGHT OFFICE but with COMMERCIAL REGISTRIES. The purpose of this bill seems to be the enrichment of corporations to the impoverishment of the people. If this bill passes and you want to protect your work, you will be required to pay a fee FOR EVERY SINGLE WORK OF ART ALREADY CREATED and EVERY SINGLE WORK YOU WILL EVER CREATE. Additionally, you will be required to register with more than one commercial registry to secure your copyright protection. Now let’s see, I have just on RB 250 works. If I have to pay $5 USD per photo to three different registries to protect my copyright that will cost me $3,750. This is just the cost to protect the work I have uploaded to RedBubble. What about the other 8,399 photos on my computer? If I ever print them, upload them, show them in a gallery, I have to pay for each of them as well. / Folks, this is serious. EDIT – URGENT UPDATE The Orphan Works Bill is out of committee. Now is the time to zealously advocate for defeat of this bill. Please go to the Illustrators Partnership of America Legislative Action Center for more information and useful links to contact your Senators and Representatives. This Bill will substantially limit your ability to recover financially if your work is infringed, even if your work was registered with the U.S. Copyright Office prior to infringement. So registration with the U.S. Copyright Office is a waste of your money if this Bill passes. Important elements of the HOUSE BILL Coerced Registration • The Orphan Works Act would force artists to risk their lives’ work to subsidize the start-up ventures of private, profit making registries, using untested image recognition technology and untried business models. These models would inevitably favor the aggregation of images into corporate databases over the licensing of copyrights by the lone artists who create the art. International Impact • Because an unmarked picture cannot be sourced or dated, works by artists outside the U.S. will be as vulnerable to infringement in the U.S. as work by domestic artists. • Presumably the Copyright Office and Congress expect non U.S. artists to register all their past and future art with the new hypothetical U.S. databases, or see their work exposed to commercial infringement under U.S. law. • It is a violation of the Berne Convention for the Protection of Literary and Artistic Works for any country to impose registration on a rights holder as as a condition of protecting his copyright. Please take this opportunity to protect your rights under the current copyright law by speaking out against this proposed legislation. By Scott Bourne When photographers turn pro, they face an important issue: How to price their products and services. Unfortunately, photographers are at the low end of the pay scale because they usually don’t apply standard marketing and business strategy when pricing their work. The goal of this article is to give you advice that will let you earn what you are worth and at the same time, elevate the price positioning of the entire industry. START AT THE BEGININNG – KNOW WHAT YOU ARE SELLING Are we selling square inches of paper? For some reason, the first thing that enters a photographer’s mind when pricing is print size. This has cost more photographers money than you can imagine. The most important thing to know here is to build value in your product. You do that by considering ALL the factors that go into making a salable image. So what are we selling? How about that creative eye? Anyone can buy a camera but can they see through it the way you do? Are the hours you spent training for this moment worth something? Your mechanic, doctor and lawyer all get paid for their time, shouldn’t you? Then there is your present technical ability. The casual amateur may not be able to get the most out of the same equipment as the everyday pro. And speaking of equipment, you need to consider the value of all those gadgets you have laying around the studio. When you price, charge for your logistical skills, intelligence, time and your ability to translate your client’s desires into a visual statement. You should consider standard usage and copyright in the price as well as basic business economics. And here is one of the first places that photographers stumble. They aren’t honest with themselves about the cost of doing business. In order to price something, you must know what it cost to make. Here are some things to look at: Pricing Economics 1) Overhead / 2) Profit / 3) Market Type Calculating overhead requires you to consider all the costs that are associated with being a professional photographer. That means: 1) Equipment depreciation / 2) Insurance / 3) Rent / 4) Licenses / 5) Legal Fees / 6) Accounting Fees / 7) Payroll Fees / 8) Salaries / 9) Taxes / 10) Utilities / 11) Production / 12) Repairs / 13) Printing / 14) Postage / 15) Office Supplies / 16) Subscriptions / 17) Dues / 18) Advertising/Marketing / 19) Transportation/Shipping / 20) Travel / 21) Misc. Calculating profit is a bit easier. You consider your cost of doing business by allowing for a percentage of your overhead to be applied to the cost of each job. From there you add mark up. This can be based on any number you want but a good starting point is to double the cost of your product. Now you also need to adjust this figure based on market type. Is the image being used in a small or large market? Will thousands of people or just a few see it? What is the value to the client? What will the client do with your image? What choice besides you does the client have? Are there 50 photographers in town or only three? All of these factors go into calculating a price. STRATEGY Now that you know what you have, what you are selling and what it costs you to make it, you need to devise a pricing strategy. This can be as simple as jotting down some basic facts. 1) What is your overhead? 2) What is your marketing strategy? 3) What is the competition charging? 4) How much income do you need to survive? If you have a real business plan, you will have answered most if not all of these questions. If you don’t have a business plan, now would be a great time to write one. It doesn’t have to be fancy but you need to be able to articulate your goals or you won’t be able to measure success. EDUCATE THE CLIENT After you have decided on a strategy, you need to start educating your clients about your business. Most people have no idea what it costs to run a business, let alone a photo business. Share that with your clients. If you run a portrait studio, make sure they understand the differences between what you do and what the chain studios do. If you are selling fine art nature prints, discuss your education and training, the cost of dues to professional organizations, etc. When dealing with art directors, let them know when you have purchased new cameras or computers that feature advanced technology. Once the client can see a nexus between value and price, the higher rates become less of a stumbling block. You can embark on this education process in a number of ways. Issue press releases that tout your equipment acquisitions, attendance at seminars and new employees. Bring these things up in casual conversation when selling. Publish a studio newsletter. Conduct your business in a manner that exudes professionalism. CONCLUSION There is one last but very important step that you must take to profitably price your photography. Ask established photographers how they bid jobs. Smart photographers who have made a good living at photography will gladly help beginners with this information. They realize that if you are new, you might undercharge, thereby bringing prices down industry-wide. Ask for help. You’re likely to get it.     Be open minded about your camera gear You can make a tripod for only a few dollars, tracing paper makes a great diffuser and a trip to a hardware store will give you very bright lights. Yes, there are downsides, and for the technically perfect photographer, these suggestions will be a very funny joke. The point here is keep and open mind and try new things before forking out $100 for a piece of shiny material that resembles a $5 dash board cover. Unless you use a biscuit tin to take photos, eventually you will want to buy a new camera. Shop around, get advice, try out a friend’s and when you walk into the shop, don’t spend hundreds of dollars on accessories that you wont’ use. It doesn’t hurt to haggle a bit either. When the salesman tries to close the deal, my typical response is “what else are you throwing in?” Studio Hire So the first question you ask yourself is “Do I know anyone who already has a studio set up?” If the answer is yes. Skip the rest of this section, suck up your pride and ask them if you can visit and have a play. The rest of you, ask yourself what you are paying for. Is it the chance to get a professionally lit shot? Maybe you could try a lighting course that will not only give you many opportunities to work with professional lights, but will teach you the theory and science of lighting. Often these courses are much cheaper than a similar amount of time in a rented studio. Do you want to try shooting in more controlled conditions? Try clearing out a room of your house and setting up a few scenes. The results may not be brilliant but it will give you a sense of how much time you can spend setting a shot up before you get to click the button. If you are certain that a proper studio is for you, consider hiring it out through a camera club for a discounted rate, or hiring it out with a couple of other photographers to minimise your expense. Models and TFP Models and photographers have one thing in common – they both need a portfolio of photos to proceed in their career. This is why Time For Photo shoots have become so popular. But before you jump up and down about using a free model take a second think about what is fair and ethical. At the end of the day, both you and the model should be happy with your arrangement. If someone feels short changed, you should consider modifying your approach. This is my rule of thumb. If a model approaches me to take shots for her portfolio, and I am working to her brief, she should pay me. If we have put our heads together to come up with a project and proceed on equal footing where we both use the images, then neither should pay. And if I conceive and art direct the shoot and have priority over the image rights, I should pay the model. Basically whoever comes out on top should be paying the person who is doing them a favor. Then there are test shoots, these are almost always done on a time for photos basis. These shoots are a bit like ‘warm up’ shoots for the model and photographer to see if they want to work together properly. They are also a chance to test new ideas or equipment. Often the images taken in test shoots are less than great, and if they do turn out, they are most commonly shared equally between all parties. If you are requesting a model release form because you intend to profit from the images, in my opinion, the model should be paid or you should have an arrangement to split any profits. My plan of attack is to put out a call for models. Then I will do a test shoot with the model who has contacted me and we either have equal rights to the shots or split them down the middle. If the test shoot goes well we may arrange to work together again. This might mean doing an even split of “her ideas” and “my ideas” for no payment, or it may be paid work if I am contracted to produce shots for a commercial job.     Starting my own blog on this cause why the hell not! I WOULD LIKE TO RE-ITERATE SOMETHING SOMEONE SAID, This is an ARTistic community site, I been here since almost the beginning and am seeing a lot of people come here ASSUMING that this is a PHOTOGRAPHY SITE (which can be art too can’t it), BUT SOME DAYS I FEEL LIKE YOU ARE TAKING OVER… So you can take 2000 photos in a day and 1500 of them are good and you can upload them over 1 week. Great… To do a good piece of art take WAY LONGER THAN THAT…. even digital. Just something to consider cause MAN THE ART IS GETTING LOST, SO LOST IT IS MORE THAN ANNOYING. AM I AM A GRAPHIC ARTIST THAT TAKES PHOTOS. It really makes a lot of ‘photographers’ look a bit silly if they are commenting on my images and saying things like ‘nice treatment’. GRAPHIC ARTIST/DESIGNERS don’t really treat photos, we manipulate them and in a lot of cases mutilate them and take them completely out of context. Change light sources, create alternate realities and unrealistic artistic things. SO HERES A BUSHFIRE THAT COULD USE A BLOG OF ITS OWN…. WHERE DOES PHOTOGRAPHY STOP AND GRAPHIC DESIGN START.??? If you clip out a sky and replace it with another one, alter nature, add colouring, tone this, airbrush that, lengthen that body, etc. etc. etc. Aren’t you manipulating the original image and then that becomes GRAPHIC DESIGN??? DIGITAL ART – Art created using a computer. PHOTOGRAPHY – An image captured as close to what the eye can perceive (of course I know that you mess with brightness and contrast and have been doing tweaking forever, but wasn’t that originally to replicate the record of the event)... WONDER HOW MANY PEOPLE GET TRICKED BY GRAPHIC DESIGNERS IN THE MEDIA POSING AS PHOTOGRAPHERS. and I AM REALLY SICK OF HEARING ABOUT MONEY HERE… ARE YOU ARTISTS OR INDUSTRY… We all want to make money doing what we love, some of us do art regardless of money…

    David, my ex-pat London lawyer friend had a visit from his parents this week….. …….Lord and Lady something or other…… ‘Loads-a-Money’ I think……man have they got serious cash ……I once visited their huge mansion in Bath, England…. monstrous place, even their chauffeur has a chauffeur. They’ve got glass hand bells for summoning servants and sporting trophies in a cabinet. / He says to me “my parents are here why don’t you come round Friday after dinner” …….We’re just worlds apart. He’s had a a long and successful career… I come from Dagenham in East London. People who live there don’t have careers they‘re well pleased just to have jobs. / It’s not twinned with anywhere that’s for sure. It hasn’t any strange attractions which must not be missed, or an information centre…… nobody wants to go there…. It has got an escape committee and a suicide pact with Stevenage. / Our house was really pokey….. two short strides and you were half way up the stairs. The walls were so thin if the television wasn’t switched on you could hear next door’s budgie talking to itself. Mind you these days the budgie would be more entertaining…..Television has proved that people will look at anything rather than look at each other. If I settle myself in front of the T.V. for, I don’t know, ten minutes. I am in serious danger of remaining there for ever!!……… I cannot drag myself away!!!. I sit there and watch the most crappiest movies into the wee small hours , eyes bulging out of my head. I know where the remote is …. It’s on top of the telly but I can’t be arsed getting up to get it!! / I was addicted as a kid……… / I loved the cowboys…..Hopalong Cassidy, Rin Tin Tin ,The Lone Ranger, The Cisco kid…………. I’d spend hours in the shed afterwards slapping me chaps…………………………………......as cowboys did !!!!!!!! / I arrived at David’s, knocked on the door he opened it wearing a dinner jacket and bow tie saying….” I thought I told you to come round ‘after’ dinner” …..I said “That’s what I have come round ‘after‘…… (know what I mean ….worlds apart.!)………. / Have you ever been for a stuffy tea in the house of the rich….they have fish knives and cruet sets. I’ve never seen a fish knife in my life. Come to think of it that’s not strictly true ….my old dad had one that he used to scrape out the chicken shit from the nesting boxes. …… I’d spot him a bit later spreading butter on his toast………… same knife!!!………………… / David’s mother said ”Do you mind if I sit on your right hand at dinner?” …(you’re ahead of me I’m sure..) I said…” I guess so………. But I might have to use it!……….( not a smile ..not a crack …. Not even a grimace.)… I thought some Friday night this is tuning out to be. I know the dying process starts the minute we’re born but somehow it accelerated this night. We started with consommé …. It tasted like someone had left a bowl of warm water and a piece of meat in the same room together….. and NOTHING is less important to me than what fork to use… / She said “ I have no concern for the common man other than he should not be so common”…. I said” Go take a flying fuck at a rolling donut!” and it was all down hill from there………..

You can find out more about them here: http://www.419scam.org/emails/2006-07/08/610142.59.htm http://www.419scam.org/419scam.htm I don’t know if this is a normal occurrence at redbubble, but it certainly has never happened to me before here. I am infuriated that this sort of behavior exists on this fine website. Of course I immediately reported the email, but I knew I had to let everyone know. Even though this is a well known scam, for every few that know, there will be others that don’t know and can be fooled. These scams work, thats why people do them. So I thought you should all be informed of at least this one Scammer. Hopefully everyone can be educated about this sort of thing, and not fall for these lies. Thank you for your time. Vestque

I always need it!! Well it does come in handy …especially with the recent news….. My daughter has a new man in her life ….. I wish them a long and happy marriage , the same as I wished myself. …..Mind you that dream was shattered a short time back when after thirty years of marriage my wife and I decided to call it a day. / Let me tell you wether a relationship is good or bad, after thirty years of being together when that person is no longer there it leaves a big gap to fill…..     This was my rather long winded reply to a redbubble forum post here / So was I full of it or on the money? / Don’t forget I’m a writer – besides couldn’t think of a picture that would express these thousand words :o) / Hope you have a coffee on hand :o) ~~~~~~ * ~~~~ You mean if I write long enough I get to eat ?? Off to write now … too busy to write here …. / no wait! / If I write here will I get to eat sooner ? Now someone said / “Great art is done by people who are dead that’s what makes it great! ” / Bloody hell! If I could get a bloke to paint something when he’s dead I’d think it pretty good too!!! ... Would that help me eat ? The consensus appears to be that when you die you will automatically be great artists – / W R O N G !!!! / So many people who can do wonderful creative art will die with their work not getting any further than the family home! / What makes art great is the passion of the artist matching the passion of the audience. / What then makes that art popular to the “Classic” standard is someone taking that art and getting it seen en mass! [to get lots of passionate audience connection] / What makes art valuable is the uniqueness of it … especially if it is well liked and to a lesser degree skillful! Critique is only useful for technical aspects. Who is anyone to say you did that wrong? It is art it is the expression of your imagination your philosophy your soul! It is how you view the world you live in. That is the whole point of art – to show a reality that may be thought of but could be or not be easily projected. Someone mentioned “the Scream” and other great yet seemingly childish works of modern art. The whole meaning of that art style was protest against the horrors of WW1 – the shock of the returning wounded the catastrophic effects of the war on all of society. And the artists were voicing the general populas’ ideas that war is wrong – which was not what the wealthy wanted. Very typical of any period of time throughout History – some even say that politicians define/ed the bible! History was recorded by artists and archived by politicians. It is the cross reference of several cultural records that determines the facts / “If a tree fell in the woods and no one witnessed it – did it make a sound?” What was kept for historical reference is what the politics of the day wanted to be known for…. it did not necessarily truely reflect the entire reality of the time. Only this last century – with the instant truth of cameras and the free press and especially satellite TV – has the reality of the day been recorded accurately and even then the outcome can be edited and tampered with and in some cases hidden or destroyed. And in the education department it is notorious for cutbacks to be aimed at the arts first! That is a scandal that I can never find a justification for. Especially when Sport is favoured so strongly over it. / Yes alright it is important to be fit and healthy but true health comes from inner peace and that is achieved through creative expression and validation! When people stressed out due to competition [and face it living is just one huge competition – wangling money to meet all the demands vs the ability to work enough to make said money !!] the first thing the therapists do is ask what hobbies you enjoy; and if there is none in your life they strongly recommend you take up one! / Long term unemployed people can be reassigned work far better if they are encouraged to do a course of creative manual labour – such as furniture restoration. It will invigorate the right endorphines (?) in their mind and give them a sense of completion and validation. That is because without a creative hobby your inner being will not be expressed and your sense of self not validated! – the two main root causes of depression. I would rather see the money go into the education arts programs – language culture appreciation & expression – in equal doses as buying more art. Yes bring good art to the country and promote good art of the country but also teach the people the value of these to their own existence. Everyone else wanted to justify the money being spent or not being spent on art when they have no idea what art the gallery is actually thinking of buying! I like the idea of a giant Redbubble art wigit to show what is being done and posted moment by moment [would also need a bank of smaller screens for viewers to check for longer … perhaps jot down our contacts and purchase something too] This would indeed show the truest art happening NOW and give the strongest feel for what art styles the population does value. / I suggest RB pitch that to someone … pitched right we would be the innovators of the world of art! Art to me is living culture recorded for all to see / Not all of us can do it not all of those who can can do it well !! But remember … / “Beauty is in the eye of the beholder” and perhaps we should remember the “Blue Poles” and “Yellow Peril” pieces that our “experts” wasted millions on in the past. / What is the government smoke screening this time ??? / What do they really want the money for? [10% actually spent on the art piece and the rest quietly used somewhere else] Now that was my soap box rant for sure! / Keep Happy !!! :o) {packing up soap box & megaphone now … oooh someone put coins in my megaphone bag :o) thank you !!! Now perhaps I can eat YAY!!! :o) }

    As from Monday,I will be away on holiday for 2 weeks,and hope you will not miss me too much..lol!(Yeh Right I hear you say.) / This has been planned from quite a while back,when hubby was not very well,so this break will do him good I think. / Last week,we received another whopping Electricity Bill to the tune of £320+ per quarter,and I was absolutely devastated,as the bill before that in February was for the same amount..how can this be? / We live on a State Pension..just his,and we are given £200 per year towards heating allowance by the Government,and our heating bills average out at £1112 per annum. / On seeing the bill,I went into a deep decline,and don’t mind admitting I am so upset at the timing of this. / I immediately decided to tell my family that I won’t be going,as the bill has to be paid,and if I have to watch every penny while I’m away…I might just as well stay at home!Hubby would still go,which would allow me a little time to sort myself out,because he’s doing my head in too..I just need SPACE and time alone. / I have cried,sobbed and moaned constantly since Tuesday,but hubby just lets it go over his head…and this is frustrating when he is so calm and I am literally going ape at the unfairness of it all. / I have sat and cried today,and hubby is so concerned for me,he doesn’t want me to be alone as he’s not sure what I would do,but he is still going on holiday..(Yep really worried)! / So,I told him I would go on Holiday,and ignore the bill..after all why should I worry if nobody else is worrying..it’s doing me no good at all,and I am below my normal weight of 6 stone now….the worry is killing me slowly but surely! / Anyway people,I will attempt to enjoy myself as best I can,but I apologise for not seeing or commenting on your work for the next couple of weeks,so take care all of you,and I will return,refreshed and raring to go..I hope! / By the way,if any of my work is featured or I’ve won a competition or something…(chance would be a fine thing)lol..could you tell me by BM please,so that I have loads of BM’s to come home to. / Missing you already my dear friends / Big Hugs and Squeezies from me to you. / xxxxxxxxxx / C
