Congress is likely going to be considering new Orphan Works legislation in the upcoming session This legislation would require all creative works to be registered, for a fee, with private copyright registration companies. If a work is unregistered or cannot be located with a good faith search, it becomes an ‘orphan work’ and thereby become free for both non-profit and commercial uses. What does this mean for us? Well, if current statements are true and the proposed legislation bears a strong resemblance to the version of the bill put before Congress 2 sessions ago it means that a lot of online artists are going to be boned royally if this passes. Here’s a breakdown of why this legislation, if allowed to go through, is incredibly bad for artists, writers, and musicians, especially those of us who post work online: -It makes no distinction between the work of international artists and the work of American artists. Which means all of you lovely people in Australia and the UK have just lost your copyright in the United States unless you’re willing to pay a fee (and don’t get me started on exchange rates) to at least one, and more likely several, American companies. This is the same reason I detest the current internet gambling laws in the US; American legislation should only affect American citizens. When you start trampling on the intellectual property rights of the citizens of other countries, you are violating international law. And guess what? By allowing American companies to ignore the intellectual property rights of foreign nationals, we allow them to do the same to us under provisions in the international copyright law. -It places an onerous financial obligation on not just working artists, but anyone who shares an image or a piece of writing online. As artists we already have significant expenses related to the creation of our respective works. What this legislation does, in essence, is force artists to pay a fee to a privately owned company for the ‘privilege’ of creating our work and retaining the right to use it as we deem fit. Using myself as an example: Between my fractals, writing, photography, painting, and other pursuits, I create approximately 100 new pieces of art a year. If there is only one registration company, and their fee is a supposedly reasonable $5 per work, that means I’m paying $500 a year to be allowed to retain my copyright. If there are 3 companies, I’ll have to pay $1500. This gets even worse if you consider casual posting. Assume the average family takes 300 photos a year, between birthdays, vacations, and other everyday things. If you don’t register your private family photos with these companies (to the tune of well over $1500), you could find little Jimmy’s birthday photos plastered on a billboard without your consent. Which brings me to my next point… -If your work is deemed to be an orphan work, you have little hope of regaining your copyright or of receiving full compensation for its use. If you take someone to court for improper use of your work, the onus is on you as the creator to prove that the work is yours, and if the courts decide in your favor, there is no allowance in the legislation for the recovery of legal fees. Not only that, but the legislation does not require that a company cease commercial use of your work, even if a court rules in your favor! The only requirement is that the violator of your copyright pays you ‘fair value’ of your work. You lose your right to damages, and you lose your right to tell them to stop. -Anyone can register an image without proof that they actually hold copyright. Which means that Billy Joe Artthief from down the street can register your works and steal your copyright. Once again, if you sue and manage to win your copyright back, you are not entitled to damages. -The technology being proposed for use of enforcement of the law has a woefully high failure rate. On March 13, 2008, PicScout, the creators of one of the software applications used in the registries, stated to the House IP subcommittee: “Our technology can match images, or partial information of an image, with 99% success.” Please turn that around, and notice that 1% failure rate. That means for every million works that actually are registered, 10,000 of them are going to not be found in a search and deemed to be an orphan work anyway, in spite of being properly registered. This is just the tip of the iceberg, folks—the problems with this legislation are myriad. But what it all boils down to is that IT IS LEGALIZING THE THEFT OF YOUR WORK! This is the reason why international copyright law expressly forbids coerced registration as a condition of maintaining copyright. So please, if you live in the US, get in contact with your local US representative and let them know why they need to vote against this legislation. It doesn’t need to be as long or as detailed as what I just wrote, but it does need to be heartfelt. Let our government know that we do not want them legalizing the theft of our creations! After my Interview / by the lovely and talented / Marilyn Brown / the torch has now been passed to me. / / I am choosing a very special person whom I have not only been inpressed with his work but how he gracefully handled his cancer. He continued to journal (deleted by RB) write poetry, paint and upload work, even on really bad days. I never heard him complain or feel sorry for himself. He has shown me how if struck with life threatening disease like he was , how I would want to handle myself . I admire him for his optimistic spirit as well as his wonderful work and his wit. Shayne has a burning fire in his soul to get his message across in his work, I love his feistiness and tenacious personality. I have come to see the beauty in him and I hope you will see it and get something from what he has to say. Shayne what inspired you during your illness? Inspired? I’d like to say I was inspired, but it was a far more earthy experience than that, basically it’s been a constant slog, claw over fist, the struggle for survival travelling with the bloody nightmare of intensive chemo. I don’t know how I got through it, but I do remember some things – the smell of fresh cut grass, the thought of laying on the beach getting sunburned, the colours of moss and pidgeons, six litres of Stolichnaya, Rembrandt, Elgar and Shakespeare, smelly Brie and laughing with friends. p.s. I lied about the vodka, I don’t drink. How did making art help you through your cancer journey? I think we can cathart the nightmares onto a canvas or whatever our medium/a so we are purged of them. How do you look back on your life now that you are in Remission in relation to your art.? Looking back through my portfolio of the last 5 months, with a view to culling it, reminded me of some milestones in that short time. There was the Mardi / Gras / which involved working 12 hours to capture the parade and party. It was, I thought, “the last thing I might do,” so, although I felt pretty sick, I took the job on. It was such a wonderful night, I don’t know how I photographed anything through my tears. The first work I did regarding my cancer was this one: (deleted by RB following forum dispute) which was the ultrasound of the lymphoma. I decided right from the start to try to make something beautiful of it. Then there was some work I did when friends kindly came to take me on outings and I saw how truly beautiful life is like this / one The transition (deleted by RB), was created when I believed I was going to die, and looking back, I’m surprised I seemed so impassive about it. But I do remember taking a long walk in the wee hours of that morning, sitting alone in the dark in a park, coming to terms with the idea; so I guess this is the resolution of that. I took / this shot when I got back that morning, everything just seemed so serene. It became important to me that others should understand that HIV is associated with my lymphoma, that being HIV+ is not often a walk in the park There were some poignant moments when I felt very much at / peace and full of hope and times of great empowerment when I became convinced I was going to conquer this afterall My last two / works were the first paintings I’d done for six months and intended to show a great calm after the storm. :) I sit here in my hospital bed awaiting my final discharge papers, I’ve finished 4 months of chemotherapy, the cancer is in remission and my future is looking very exciting. It is truly amazing how this experience has heightened my appreciation of life; and while recovery from the chemotherapy will still take some months, I have so much to do and don’t want to waste a single moment. What would you like to tell someone going through what you have just been through? Well, I see it like this. If you imagine time doesn’t exist, where you want to be is already here, just across a field of shit. All you have to do is keep putting one foot in front of the other; and you’re there. Oh, and what I’ve discovered is that the life programme crashes everytime you try to run the manipulation, resentment or self pity programmes with it. And last in meeting other patients here who’s prognosis was ‘incurable’ I always felt myself very fortunate; as I did too for being in such a world class hospital, and with such wonderful staff. :)

I have a short attention span. Which is likely why I can’t settle on any one genre of photography and DEFINATELY why the thought of answering 50 questions sets my insides a-trembling. So instead I though I would give you just TEN completely weirdarse things about me. 1. I have a phobia of touching frozen things. When I do its like nails going down a chalkboard {{shudders}} 2. I can suck spaghetti into my mouth and wriggle it about so that it comes out of my nose. I know… its a God-given talent, you have my permission to be envious. 3. If I see someone else’s spit in the bathroom sink when I go to brush my teeth I will throw up. EVERY time! I think thats a hangover from when I was pregnant with my eldest and had morning sickness… every day. I even threw up the morning I gave birth to him! 4. I have weirdarse little toes. All the others are perfectly formed but my little toe is a freak. Its like when I was made the big-fella upstairs ran out of moulding clay or something and didn’t have enough to finish me because his clay order wasn’t due to be delivered until Monday. 5. I only ever use Smart Sugar in my coffee, and yet I have not noticed a notable increase in my IQ. 6. I own a beanie with ear flaps. WHAT? Like I care about fashion when my aural health is at stake? 7. I can say the alphabet backwards faster than I can say it forwards. Hmmm… maybe that Smart Sugar is working! 8. I can’t sleep unless I have at least a top and knickers on. Don’t get me wrong, I am no prude by any means… I happily dance naked around the house – weather permitting – but I have this fear that there is going to be an emergency in the middle of the night and I am going to find myself out on the curb without a stitch on! NOT nice for the neighbours giggles 9. I have an amazingly athletic and versatile tongue and yet I couldn’t whistle until I was in my 20’s… What’s that? You want to know what I can do with my tongue? Suffer baby…. 10. My very first macro shot got featured in the 1:1 Macro group today. 10. When it gets really cold like it is now I’m afraid my bum is going to freeze to the toilet seat 10. Ummmm…. I forget… okay, that whole short attention span thing has just kicked in. 10. I once ate 3 dozen choc chip muffins and 2 litres of custard in one sitting. I like to move my images around in my portfolio. I sometimes will bring some of my work that I have posted months ago to the front page. This is easy to do by using the ‘Art’ tab which will display all your images in a list. One the far right hand side of the page are 4 blue arrow controls: 1st Arrow: when clicked will move that image to the very top of the list on the first page. 2nd Arrow: when clicked will move that image up one position at a time towards the top of the list. 3rd Arrow: when clicked will move that image down one position at a time towards the bottom of the list. 4th Arrow: when clicked will move that image to the very bottom of the list on the last page. Now heres the deal… when using the 2nd and 3rd arrow it is quit a slow process as the page refreshes each time to show you the new position of the image and you then have to move the cursor up or down to the new position of the arrow and click again….. / This is what I have discovered, if you carefully keep the cursor on the arrow and very quickly click the left mouse button, when you stop and the page refreshes it will have moved the image the number of times you have clicked the mouse…...

Then let me introduce you to Esther and Ross, my local greengrocers at Glenbrook. Esther and Ross bought the little greengrocer business about 3 months ago. As locals, we all waited with anticipation wondering what sort of changes they would make to what had been a tired little fruit and vegie shop. Please take a close look at the artwork on their walls…look familiar?? They certainly looked familiar to me and finally, after doing a little project for Esther and Ross, I got around to asking them about their artwork. The conversation went sort of like this: Adriana: Esther, I’ve been meaning to mention to you – that apple print, where did you get that from? Esther: Oh, from the internet… (Adriana immediatley jumps to conclusion that the image has been bought from a fake site, rather than original owner’s site. Cue melodramatic music. Facial expression is one of shock and horror and perplexion. Esther, seeing this and hearing the music, quickly clarifies.) Esther: You see this friend of mine told me about this website where you can buy all this artwork. It’s called RedBubble. (At this point, Adriana promptly faints flat on the floor not believing what she’s hearing.) Esther: (while picking Adriana up off the floor continues) She told me if I wanted to buy artwork for the shop, I really only needed to go to RedBubble and I would find all the images I wanted. So I searched for the fruit and vegie images I was after and bought the posters. Adriana: Wow, OMG, I have to journal this and let the others know that there are real buyers out there _ And that all they need to do is tag their work. _(wistful look that lingers like a daytime soap cliffhanger dream sequence. Cue more melodramtic music.) (End of conversation, and reality descends once more) So, here’s the photo I took of a proud Esther and Ross showing the artwork they bought on RedBubble. You’ll recognise the artwork of Jerry Alcantara here, here, here as well as an image from shall here and an image from Renee Tran here . There are 3 other posters hanging on the opposite wall, also by Jerry Alcantara’s . And what have we learnt: / 1. Tag your work. Pretend you’re a buyer – how would you find your work on RedBubble? Use appropriate tags that are relevant to your image. / 2. That real people buy artwork on RedBubble, and not just friends and family and ourselves. / 3. That Redbubble in Melbourne can act as an avenue to sell the work of photographeric artists in Italy, the US and UK to a business in Glenbrook, NSW, Australia and is seen by hoardes of tourists everyday. / 3. That I needn’t bother with pursuing scriptwriting in the future. ; p

Hi friends, I noticed some of you don’t have any registered copyright on your art… you should as new laws are coming in which means if your art is not registered copyright it will be open to the public domain and any one will be able to copy it and use as their own…including advertising & media companies. If you go to My Free Copyright you will be able to join for free and register your files of art there. It use to be free and still is to me but owlspook went and joined and advised me they now charge US$27 per year for unlimited … it is worth it. They will send you an email with the details of your registered art which HAS TO BE KEPT in a file on your computer … DO NOT DELETE that email they send. That is your legal warranty that you own the copyright. It explains it all on that site. Until you can do that you can put the link below on your work so that it will help deter others from copying your work. http://myfreecopyright.com/images/mfc_protected.png You just need to copy this and past it to your description area where you upload your art and put the ! at each end of it with no spaces…then the logo will show up on your work. Once you have registered your art then copy the MCN (My Copyright Number) from the file on that site and paste it under the logo. If you want to see what I mean have a look at any of my art on my site and you will see the logo with MCN under it. Copyright applies to all art whether painted, photographed, clothing or material designs, computer generated fractals & the likes, music and writing (including lyrics, philosophies, poetry, novels and novellas). I have had enough!.... I have been working on a logo for Jemima Loves Big Ted for a loooooooooong, looooooooooooooooooooooooooooooooooooooong time and I am totally at a loss. I hate each and every design that I have managed to come up with, and I think its now my turn to put it out there to you fellow designers to help me with it. I am willing to pay, however having just finished being a student and not having loads of work right now, I am not rolling in it. Would saaaaay…. $100 be enough to tempt some people? I am going to follow along the same sort of guidelines (and thanks for the inspiration Dan) of Tate in his quest for his look and that is - 1. I will choose my favourites from the submissions and put it to a public vote. 2. I may not decide to use any of the submissions, but if I do choose a logo that knocks my socks off I will pay the designer $100 cash or equivalent in any other form of currency or services (I am a great cook and love gardening, I even do lawn mowing) 3. You have until 23rd October to get your designs in (is that long enough?) After which voting, then choosing. Inspiration – Ummmmmm….. Damn, I don’t feel particularly inspired right now and have been going over this for years so whatever you can come up with is probably better. Colours – Not the biggest fan of pink, but will certainly allow it, if it looks UBER Cool within the design. Note: It does not have to be a literal interpretation of my name. Okay… Here’s the catch… / / The editor of that Art publication wants me to write some kind of a bio thingy… Including some kind of interpretation of the two pieces of Art he’s selected to show and publish. / / Well I’m SHIT at writing bios, especially the boring factual shit.
