This Journal addresses United States privacy & commercial use. The laws in your country may be different. Commercial use of a person’s likeness occurs when the image is used to endorse a product or service. Editorial and artistic use of an image does not endorse a product or service. As long as you aren’t using someone’s image to sell a product it is artistic and editorial and can be sold, When you use someone’s likeness to sell goods or services a model release is required. It seems that the reason stock companies require a model release for photos of people is that it is presumed that any business that buys your photo of a person does so with the purpose of using that image to sell their product or service. Street candids of people you do not know, if sold only as photos not associated with any goods or services do not require a model release. If a model release was required for every publication of a photograph of any recognizable person, magazines, newspapers, and the like could never publish a photo of a street scene (such as an accident or a protest) where people may be recognized. The landmark United States case, Pavesich v. New England Life Insurance Company, 122 Ga. 190; 50 S.E. 68 (1905), first defined the scope of privacy rights and commercial use. The Court held: “So thoroughly satisfied are we that the law recognizes within proper limits, as a legal right, the right of privacy, and that the publication of one’s picture without his consent by another as an advertisement, for the mere purpose of increasingly the profits and gains of the advertiser, is an invasion of this right [of privacy].” The more recently decided case of Nussenzweig vs. diCorcia, 2007 NY Slip Op 02413 [38 AD3d 339], seems to sum up the editorial use of a person’s likeness. The Court declared the following: “The sale of an individual’s image in a limited edition of 10 photographic prints for an aggregate of some $240,000 is a far cry from the use of a person’s likeness to adorn sacks of flour distributed by the thousands, the situation posed by Roberson v Rochester Folding Box Co. (171 NY 538 [1902]) that Civil Rights Law §§ 50 and 51 were enacted to redress (see Arrington, 55 NY2d at 439; Davis, 90 AD2d at 378). The publication of plaintiff’s portrait in both the popular press and art media confirms that the image is “a matter of legitimate public interest to readers” so as to bring its use within the newsworthiness exception to the privacy statute (Pagan, 32 AD2d at 343; see Stephano v News Group Publs., 64 NY2d 174, 184 [1984]). Thus, the inclusion of the photograph in a catalog sold in connection with an exhibition of the artist’s work does not render its use commercial, as plaintiff suggests (Hoepker, 200 F Supp 2d at 350 [construing exhibit catalog as “pure speech”]). If the image is a matter of public interest, it is immaterial whether that interest is satisfied by viewing the original in a museum, art gallery or private dwelling or by perusing a reproduction in an art magazine or other publication. “That profit may be derived from the sale of art does not diminish the constitutional protection afforded. As noted in Bery v City of New York (97 F3d 689, 696 [2d Cir 1996], cert denied 520 US 1251 [1997]), “paintings, photographs, prints and sculptures . . . always communicate some idea or concept to those who view it, and as such are entitled to full First Amendment protection.” The public expression of those ideas and concepts is fully protected by the First Amendment, irrespective of whether an artist or speaker derives income from such expression (see e.g. Riley v National Federation of Blind of N.C., Inc., 487 US 781, 801 [1988]; [7]Time, Inc. v Hill, 385 US 374, 397 [1967]; Hoepker 200 F Supp 2d at 350).” In summary, an image of a recognizable person, even if it is for sale, does not constitute a commercial use if that use does not endorse a product or service. Each August, the whale watching season begins in earnest on Australia’s picturesque eastern seaboard. As a result of my journey to Hervey Bay during August 2006, I had the pleasure to record the magnificent humpbacks as they frolicked in the calm waters of Hervey Bay. As most are aware, the humpbacks are still being slaughtered for what can be loosely claimed as research reasons. Horseshoe Bay – Bermagui The 10th Bermagui Seaside Fair was held on Saturday 10 March 2007 and what a spectacular event it turned out to be. Thousands of locals from the region were proud as punch to partake and witness a fun-filled day of activities. Festivities commenced on the main wharf at the Bermagui Boat Harbour at 8am with the Blessing of the Fleet ceremony. Bishop Allan Ewing conducted the blessing and also addressed the gathering of locals regarding their continued dedication in making the annual festival a continued success. During the ceremony, the dapper dressed gentlemen from the Bermagui Probus Club Men’s Choir sang hymns, and other local singers and musicians performed. The majority of events were conducted at the Dickinson Oval precinct and a large crowd attended. Bermagui Seaside Fair announcer, June Tarlinton, said “They estimate there will be around 10,000 people and judging from what I’m seeing, I wouldn’t be surprised if they are fairly close to the mark.” “The street parade is extremely popular,” said June when referring to the amount of participants and spectators. “The Bega Vintage Car Club has forty cars involved this year and they’ve never had this many ever. The way the cars have been restored is awesome.” As part of the fair each year the Bermagui Citizen of the Year is announced. This year’s recipient of the award was Candy Craine, who was recognised for her tireless work in caring for sick and injured native animals on her property. June Tarlinton said “Candi Craine was nominated by persons within the community and she was a very worthy recipient of the award.” “She has put a lot of effort into rehabilitating animals since the loss of her husband.” Candi is also an avid photographer and she exhibited many of her quality wildlife photographs at the photographic exhibition at the Bermagui Country Club during the Seaside Fair. Celebrity entertainers, Frankie J Holden and Michelle Pettigrove, were invited to perform and compere the Bermagui Idols competition. The competition catered for local talent and the performers came out in droves to strut their stuff on stage for the gathered throng. Winner of the Bermagui Idol primary school age section was the highly talented nine-year-old Sophie Halliday, who performed a cover version of the song Who Knew by Pink. Judging for the competition was carried out in a novel way, and this was done by gauging the level of audience applause when each contestant’s name was announced. When Sophie’s name was announced, the applause and screaming was deafening. You could have come to the conclusion that her family in attendance numbered 500. She was undoubtedly the star of this year’s Bermagui Idol competition. Young local band, Overdrive, belted out a few tunes for the large and receptive crowd. The street parade, sponsored by Australian regional and rural broadband internet provider, activ8me, was a roaring success as it made its way along the spectator-lined one kilometre stretch of Lamont Street. The Batemans Bay Soldiers Club Pipe Band lead the colourful parade which included floats representing local schools, various community groups, the Bega Vintage Car Club, SES and Rural Fire Service, Bermagui Surf Lifesaving Club members, Bermagui CWA and street performers. Novelty events were conducted for kids, and kids at heart, with the Chuck-A-Tuna competition proving more than a handful for participants. A little bending of the rules by some was detected, however it all added to the fun and frivolity of the afternoon. Local Aboriginal dance group, Gulaga Dancers, were in attendance and performed traditional style dances for the crowd. Carnival rides, a spectacular fireworks display in the evening over Horseshoe Bay, and a sandcastle competition were also part of the day’s festivities. Dozens of stalls were erected on Dickinson Oval with stallholders exhibiting and selling local produce and products, advertising local and regional services and businesses, and supplying food and beverages for the masses. On Endeavour Point Headland, Sculpture on the Edge featured sculptures by Alan Watt, Richard Moffatt, Michael Le Grand and the provocative Melbourne sculptor Greg Taylor. Bermagui, approximate population 1120, is situated in the gorgeous Sapphire Coast region of New South Wales and is renowned as one of the best, if not the best, places for marlin fishing in Australia. It’s also home to a fishing fleet, and is close to Montague Island which hosts numerous animal species. Other local attractions in Bermagui are the scenic Horseshoe Bay, the Bermagui Boat Harbour where you can witness the unloading of the catch of the day, and the Bermagui Blue Pool. The historic Bermagui Beach Hotel exhibits fishing memorabilia in the main bar, lounge and dining areas. It’s also a top spot for a soothing ale or lemonade. Meals are hearty and excellent value for money. High quality accommodation at affordable rates is available at the Bermagui Beach Hotel and the ultra modern Harbourview Motel. I have just read most of the comments on this site and thought I would add my two bobs worth! Firstly if it wasn’t for RB we wouldn’t be having this conversation and secondly I do have two differing views on it. Since the beginning of time most artists have had to scratch a living from their work hoping that someday somebody somewhere will recognise the genius within. It takes dedication, creative genius, hard work and talent to be taken seriously and as history will tell you, many artists have not succeeded until they have been long gone. I have seen both sides of this equasion. in the 1980s I worked as an artist, purely and solely to earn money – I was a sole parent, broke and needed to pay the rent. I handpainted clothing on request and made a very good living from it. After 2 years of doing this, I had had enough and gave it up. It was soul destroying to just paint ‘any old thing’ and believe me I sold stuff that I thought would never sell! What does that say about the buyer. Art like beauty is in the eye of the beholder. I think it was George Gittoes the artist who refused to hold exhibitions of his work for fear of becoming too commercial and losing his integrity as an artist – but has just recently agreed to hold one that explains it best…(sorry can’t find his exact quote) but he did feel that if you were painting just to sell, then your art was not ‘real’ ….I have only recently joined RB and have to say I’m impressed by the high quality of art that is depicted on this site. i have not been with them long and only have a few photos up here at the moment – this time around i only want to put work up for viewing that I am proud of and hopefully other people will enjoy – I haven’t had a sale yet. Do I care? NO – because at the end of the day I can sleep easy that I am doing what I love and sites like RB have made it possible for me to be part of a great art community. Who cares that the stuff that sells the most is ‘popular’ art – isn’t that the way it has always been…..if you have true talent, it will shine through and eventually be recognised.

Autumn is an ideal time to travel leisurely by car in eastern Australia with temperatures being mild and the days generally calm. Recently had the pleasure of a 2300 kilometre road trip to capture autumn images in Victoria, New South Wales and the Australian Capital Territory, Australia. Having never embarked on a specific autumn photographic journey before, it was an experience that I’d like to highly recommend to Australians and visitors to Australia. Most visitors to Australia follow the well-worn coastal routes, but to see the best of autumn in Australia, you generally need to travel inland for the amazing colours, scenery and magical light that exists during April/May. More and more I realize that I don’t want to create imagery that leaves a residue of oxidized desire. So many things in our culture seem ultimately to be about: “choose me buy me”. Will I merely be the tool of the salesman? Will my love be chained to the marketplace? What I dream of is an art that undoes desire and liberates the immaculate presence of the subject. But I wonder; is desire the energy that endurance needs to pursue the purity in the object. Is desire the necessary energy component that motivates the courage it takes for discovery? Desire is energizing. This energy is manipulated by everyone from the queen bee to the advertising agency-and so seems free of any meaning of it’s own. It’s politically neutral and available. Is it fundamentally and simply sexual? I don’t have any desire to be like those Buddhists that endlessly try to extinguish desire and ego…I want to know desire, and probably how to use it…Like a tea bag in hot water, I want to infuse my essence into it. I see something beautiful and my spirit is activated…My heart opens my lungs fill up. I feel happy…if I don’t become attached to having it and then can’t have it. Of course, that is the problem. We are routinely and purposefully excited. Anybody of the slightest seduction can touch you in a place where nobody can see. Every siren effects a crash of the brain into the heart. Constant debris scatters into the psyche. The debris of our culture. The debris of history. Wouldn’t it be interesting to extract oneself from those ruined old plots. There must be a new story somewhere, somehow.

I’m back to freelancing and enjoying every minute of it. I recently finished a month and a half of contracting as a fashion photographer out of town and while I enjoyed shooting, the commute and the particular studio conditions did not appeal. So far, freelancing has paid just as well and is far more rewarding. Last week I worked in tandem with my regular partner in crime, International Photographer of the Year (BPPA UK) Troy Hansen on a commercial shoot, did a shoot for natural therapies author Jost Sauer (for an ad, his website and his next Allen & Unwin title), made moonlit night time captures of an historic Ipswich pub’s nightclub promotions and also shot my usual array of madness for the nightclubs in the Fortitude Valley. My design work is picking up momentum as well, thanks in no small part to the mentoring my insanely talented twin sister has given me of late. There are lots of personal projects that have been shelved of late but it looks like this year will see a merge of the work and play =)

Redbubble is such a different place. It’s amateur; it’s professional. We want to produce art for the sake of producing art; we want to sell for the sake of validation. We want to be the most successful and well-known in this community; and so too everybody else here. We sell pictures, or we want to (still looking for that first sale); but writing, perhaps the most labour intensive art form here, is for free. Clothing, the most commercial form of art and brand name potential; yet as casual as Sunday morning. This is a funny place; I don’t get it… just yet.

Gracey brings up something that I think bears examination: Close to a year ago I sat down and took a hard look at what I was doing (stock) – you could be successful in stock, but it didn’t feel like art. While there is a creative component, it wasn’t what I wanted. I wasn’t satisfied with it – other people telling you what to create (because that’s what they can sell) started to really annoy me. I do (and used to do a lot more) work-for-hire graphic art and design. Someone would come in, holding some idea in their mind or in their hands as a sketch, and want the work created for them. If I took the job, I would then sit down and create as close an approximation of their vision that I could, using whatever tools and means I had to in order to produce it for them. And there’s the key words: FOR THEM. If you are a professional doing artwork FOR others, you are an artist, yes, but you are doing work FOR others. You are not doing your art. You are not creating artwork which is your artistic expression. When you create your OWN artwork, then you are creating your own expression and your own trademark work. This narrows the market to people who are drawn to your work…if you can get an audience. I have fallen in love with Petrol Pump and have decided to do a little promotion to the residents in the area where I took the photograph. I thought it would be a good idea to write a letter and drop it in the letter box of the residents within close proximity. Sure it might be junk mail, but it is targeted and hopefully appreciated. Here is what I wrote and will distribute to the area soon: Dear Occupants, My name is Jacob and I am a photographer. Recently I have photographed the Petrol Pump out the front of your house and I thought it might be of interest to yourself. The photograph is available as a premium greeting card or as a matted print which would be ideal to hang on your wall as a feature of the location where you reside.
