I’d like to say first and foremost I love the bubble for allowing me to show off my work, particularly as I’m still learning, which means that the quality of my work when I first came here wasn’t as good as it is starting to get now. I can thank the lovely helpful people I’ve met along the way for helping me focus better on what works and what doesn’t. As much as I loathe the negativity in the forums, I read some of the threads there and learn from them too, so thanks so much everyone for your support, or not, it’s all making me a better photographer. I’ve got a secret to share, regarding my seascapes. I’ve been lucky enough to have a friend who is very keen to get the perfect seascape shot, and for that reason I’ve been getting up at 2am or so to drive out to his place so we can then continue on to beaches 2 or more hours away, just so we can be there before dawn. The weather has to be right, there has to be clouds, the tides need to be doing the right things, and there needs to be rocks as foreground and or middle ground interest. In the 18 months that we’ve been following this course, we’ve managed to capture some amazing photos, and the shoot that gave me all these latest photos was the best so far. It’s taken his dedication to getting the conditions right, and a little bit of work from me with a camera and PS to produce this work, so please, when you look at my seascape photos, say thanks to Nick Lagos, its all down to him. His shots are a million times better, believe me! For those of you who may be interested in what kit I’m using, I have a battered Canon 5D, I use a 16-35mm f/2.8 L lens, and I bought the Lee filters to fit the wide angle so that I don’t get vignetting. I use both ND and ND grey grads, and combinations of them all, but only 2 at the most. My Manfrotto 190D tripod is not as heavy as it should be, but does a reasonable job, and I always have the cable release tied around the stalk between head and legs. I’m using the 322 RC head on the tripod, but I also really should have a level to put onto the hot shoe….keep forgetting to buy one…other than that I shoot in raw and small jpg, so I can run a quick slideshow on a laptop if necessary, or even when I get home to the clunker. I use ps and photomatix to get the best out of the shots, and my ability to use ps has been learnt through going through tutorials on the net and in manuals. Since maths and me don’t get on, I really have no idea why things work, only that sometimes I get a good result if I do “this” or “that” I get a lot of inspiration from the artists here, I can’t thank you all enough for showing me new subjects and processes. Once I read about some new technique I’ll google it and find out more. I recommend this to anyone who may want to improve their work. I’m technically challenged when it comes to using a camera, although I’m learning more and more the longer I shoot. I’ve only been shooting semi-seriously since 2004, and only came off P on my camera in late 2005. I still don’t shoot on M, unless I’m after a particular result that I want to try….and that’s how I work….hit and miss :) It’s all been digital, starting with a Canon G2, then powershot pro1, then 20D. So, thats my story, sorry if it’s a little boring, but I needed to clear up some misconceptions that I might actually know what I’m doing! There’s absolutely no truth to that rumour, its all down to Nick’s need to get the “Big Pic” and I’ve just been swept along with his enthusiasm. As all his loyal subjects will attest, he’s the best thing that’s happened to us, those of us who’ve been lucky enough to be taken into the fold, / so once again, thanks Nick, the legend lives on buddy! /

By Darren Stones With the New Year upon us, have you considered where you are going to purchase your ‘08 calendars? Before you go shopping, spare a moment or two. The courier has just delivered a new-release RedBubble calendar courtesy of James Pierce. Calendar contains pics from onetonshadow. My first impression of the calendar is that it’s a premium product and has plenty of weight – not some cheap and nasty looking thing. It’s an A3 size – in plain speak that measures; 11.7in x 16.5in or 297mm x 420mm. The cover page consists of a white matte paper which has a chunky feel to it (300gsm for the tech minded). Quite simply, it looks and feels good. From a marketing viewpoint, I believe it needs the artist’s name included on the cover page. Something for the RedBubble team to consider. The monthly calendar pages are made of (175gsm) white matte paper which has a clean fresh look. The numerals on each monthly page are not overly large, although they are easy to read. Being grey, they are more subtle than obvious and don’t distract from the artwork. There’s plenty of room to scrawl birthdays, anniversaries, holidays and due dates for your favourite debts. The title of each image and artist’s name is printed underneath the image on each of the calendar month pages. The artist’s RedBubble URL is also printed in the bottom right corner of each monthly page. So, there’s good exposure for those seeking world domination regarding sales. The binding is the white plastic-coated type and it allows for easy turning of each page. It seems a good choice for the product as the pages hang flat. Remember, 2008 is a leap year so there’s a smidgeon of extra value contained. It’s not a static destination where you stop and stare, but a dynamic gallery of photographs forever showing art that best represents what we’d like the general public to purchase. From Cards through to Framed wall-hangings, our work is available to purchase online. Redbubble provides a slick website that is so easy for choosing frames/laminates/cards/t_shirts/etc, purchasing the product and easy-delivery system. They make it amazingly easy to be a small-business owner. Or at least make a small to moderate amount of play-money on the side. I encourage all Artists to use Redbubble to get started, but don’t let it stop you in your tracks. It staggers me how many people are sitting behind their computers with tapping fingers saying, “OK, Now they can see me, they will come here any moment now to purchase my art!” “No they won’t!! You have to find the customers yourself. Redbubble enables you to purchase your own work … and then on-sell it. / My Redbubble Business In August 2007 I purchased thirty cards via Redbubble. I gave five as gifts to very close friends, simply blank cards without messages, but with a simple note … do what you like with this. / Some people kept them, others used them within minutes to send off as Birthday cards. Most asked where I got them from and can they have more? The remaining cards sold within 24hours of arrival from Redbubble! Then I emailed those people, other friends and family, showing them my RB gallery. I have repeat customers because of this initial free promotion. We order $150 worth of cards and other stuff each fortnight, either in pre-orders or for stock. I have a box of about 120 card-ographs in stock at anytime. My lovely wife keeps a very intricate and statistical ledger of all cards in stock, those sold and those on order. Clients choose from the gallery (telling me which ones they like via email, with the name of the artwork, the style they’d like it presented _card, laminate, etc and how many of each_), we order and receive, then we take it to the customer. About a two-week turn-around time. I’ve also purchased a dozen 12”x8” of the ‘prettier’ of our photographs on each of our galleries, which are easily viewed in an A3-portfolio. These are used to determine the appropriate frame and matte colour when clients choose them. Now that Christmas is gone, I can reveal that White Gums II was picked off my gallery by a work-friend’s mother here in Adelaide, I had it framed locally, and it now sits pride of place in their lounge room! I’m very proud of that!! From the corporate world through to the suburban billiards room, everyone wants a suitable image to hang on the wall. Because I have clients who prefer not to purchase online, I’ve made it my responsibility to acquire the final product and deliver it to their offices and homes. And this system works beautifully. (More about this in the next four weeks…) To parody and plagerise a famous quote: “Give someone a fish and they eat for a day, give them a camera with with a zoom lens, and they can shoot the most beautiful carp every day of the week!“

Hi and welcome to my art studio.! You are visitor number come on in, sit down and make yourself at home, I’ll go put the kettle on :) / Framed original paintings hanging in my studio Due to the lovely Robin Pushe’e requesting i post some photos of my studio…i took a few clicks…and here it is.. my studio is a double garage that was purpose built for the job. It is detached from the house, and large enough for me to pursue all my creative projects. also you will see Madonna & Child hanging in the restaurant Chill Cafe at the Manly Arts Festival in Sydney…along with the other winning entries :) The photo was most graciously taken by the lovely bubbler Samantha Goode who was kind enough to go out of her way for me to take some photos so i would have an idea of how it all looked…Thank you so much Sam!! The centre ‘tables’ were specially made to our specifications, and the other furniture all bought from Ikea / .... piece I’m currently working on with my pencil drawing of Lost and Found sitting next to it for reference, plus lots of other references, and there’s all that lovely light pouring in the window. / Large framed originals of Midnight Blues and Polly’s Pearls on studio floor / Here’s one of Karin working on Madonna & Child on brown paper, alongside for reference are Stargazer and Jess n Jumbo Karin working on the intial stages of what will become Scuba Diva I’m using chalk pastels here to fill in the large areas, then I’ll spray fixative and work in the shadows and final touches with acrylic, ink and charcoal. / Main work area, covered in reference material. I paint on the slanted easel table, some of the sketches on brown paper for Children of the World series are visible, ie I Luv Lollies and Scuba Diva. Setting the studio up took about a year of planning from initial inception. If you look closely you can see my matryoshka (russian doll) blanks in the far background. Also notice the mirror, mirrors are very important in art, if you have a problem with a drawing, look at it in the mirror (for a reversed image) and you will be able to tell what’s wrong… turning your drawing upside down will also help to reveal where the problem is. I also use the mirror if I need a reference such as feet, hands, and don’t have an image…i will sketch my own hands, feet, face….you have to be a bit of a contortionist sometimes! lol I like to hang the things that inspire me on the clothesline, including makeshift plaits from wool and dried out teabags for use in mix media applications…special greeting cards I’ve collected along the way, or particular artists that always inspire me. / A bit boring this image, my PC and printer…and messy desk area, where I work on digital colouring, etc and keep up with what’s going on here at Red Bubble / A sample of some of my canvas prints on studio floor, including Whale Dancers Two Dolls and Pearl of the Sea storage space, purpose built for the job (it’s great to have a place for rolls of stuff and keeps things nice n clean) / (more storage and the top of these benches serves as a terrific workspace and layout area. I’ve used it to create small studio and lighting effects to photograph the CHUNKIES and jewellery. You can just make out Jack and Jill on the brown paper on top of bench Loose and matted originals out on the bench, getting sorted into display folders, and frames being sanded back and refreshed after some were damaged during gallery transit Karin at work on award winner Madonna & Child with Stargazer’s flippers peeping out! Works created on brown paper, cut out and pasted onto digitally designed or plain backgrounds for maximum effect. a clearer view of the workspace from another angle, bit messy hey! The set of drawers to the right is fabulous.. it’s on castors and moves..the drawers are slimline and pull out so easily…they are full of inks, pastels, acrylics, mediums, icecream lids (for mixing paint), stamps i’ve made from cubed erasors and lots of other odds and ends. Karin gets stuck into a painting…. am often completely unaware of how much paint gets all over my face, hair, hands… kids come home from school and just giggle at me, ‘til i realise…. i’m covered in stuff and need a good scrub :) Getting lost in the moment can do that to you :) Can you see my wool plaits I use as hair models in the background, there’s a normal plait and a fishtail plait, both help me to recreate drawings of plaits…. I also use a lot of fashion mags for reference, particular for eyes, faces and fashion ideas. My bookcase is bending under the weight of all my reference books. To the right, can you see my set of drawers? In there I store colour coded fabrics and materials for my mixed media work. view of some more storage space and looking back out into our backyard which is looking very green and tropical, there’s the large roll of brown paper I’ve been using. On one I have kids fashion, clothing, plaits, kids in different poses, on another depictions of faces and in particular eyes so that I can study them and keep on track with the anatomy of them, I have another one covered in roses… they are also useful for pinning a display, or an artwork on paper, so i can take it inside and view it over a period of days…then decide what it does or doesn’t need…. all this while doing the ironing and other domestic things…so the mind is ever on the go thinking about art, and solutions to creative problems. / View through the window, of some of my original works on paper, includes Thoughts Become Things (girl in bathtub) and Little Green Teapot (my most popular image on red bubble) and Heart of Gold (girl on horse), also in view are Maiden Voyage (asian inspired sailing boat), Kiss Away my Tears (mother and daughter with rabbit) and Endless Love (asian princess in navy and gold) / Here’s some of the stuff I collect when I’m walking around, twigs, coral, flowers, dried leaves, unusual seaweeds, aboriginal artefacts/axes…tools/precious rocks, dead palm fronds, grasses, paper bark, seeds, shells, dead crustacean shells, textures…etc. just a bower bird really…love shiny things that glitter too :) Can you see the dried flannel flowers in the frame? I grew them, and mum pressed and framed them for me. I can’t talk about these filters in any sort of technical way, but I can explain what I bought, and how good they are at allowing you to shoot dawn and sunset without losing all your sky detail. I started off with a set of Cokin P filters. The filters sit in a plastic holder, that attaches to the front of your lens by way of an adaptor ring. The ring needs to fit the front element of your main landscape lens. When I used the Canon 20D the Cokin P was fine, with no vignetting, but once I bought the full frame Canon 5D, my lens had to be closed down to 24mm wide. This was unacceptable to me, since I like wide landscapes. Looking into various other filters meant spending quite a bit more money, however, all the reviews showed Lee filters to be ideal. There are a couple of companies here in Oz that sell them, and after wasting time ordering and paying in advance to an overseas company, only to find that they were out of stock, with no idea of a delivery date, I asked for a refund and contacted Mediavision in Sydney. Geoff was very helpful, and gave me a quote for a foundation kit, wide angle adaptor ring, a set of 3 neutral density soft graduated filters, and a full 0.6 ND filter. Postage was only slightly extra, and I had them in my hot little hands within the week. They all have their soft cloth or soft vinyl bags, and it’s easier to slip them in and out of there without having to take off my backpack. Before dawn I’ll generally just have the adaptor ring and holder on the lens, with no filter. As the sun gets closer to jumping up from under the horizon, the filters are brought into play. Usually I’ll add the 0.6 first, if there’s not much cloud around, and once the sun has risen, the 0.9 will be added on top. The soft graduation means that you can slide the filter up and down, even slightly below the horizon, and it doesn’t leave a solid line. I haven’t been in a situation where I think I’d need the hard grad, to be honest. The holder turns easily if you wish to switch to portrait mode, just remember to turn it back when you go back to landscape mode! Because I live in Queensland where the sun is especially bright, all year round, it’s important to have these filters to make the most of a good sky. It’s near impossible to capture sky detail AND foreground detail without them. I don’t shoot in the daytime if I can get away with it, usually we pack up and leave the beach within 30mins after sunrise. I believe that you can still make good use of the ND grads all through the day, but I don’t have any real experience of that. Even shooting waterfalls can be easier when using ND filters, because it cuts out some of the light that might otherwise over-expose your image if you’re trying for silky water. The only problems we’ve all had is when the sea mist is particularly bad. In that instance we are constantly looking for ways to clean the filters, and still haven’t come up with a satisfactory solution. If anyone can help, we’d be much obliged! A TOTAL FIRE BAN has been declared for all districts in Victoria for Sunday February 8, 2009. Update: 12.20am / Kinglake resident talking on Melbourne Radio 3AW looking for his wife ‘Vanessa’ and his two children. Update: 12.45am Urgent Threat Message – Bayton, Glenhope The grass fire that started 9 kilometres west of Redesdale south of Lake Eppalock is estimated to be over 10,000 hectares in size. The fire has spread approximately 10km in a south easterly direction to Annex Lane south of Sidonia. The eastern boundary is approximately 2km west of Baynton. Residents of Glenhope will see the fire burning to both the south and west of their township. Residents of Baynton, Glenhope and in the vicinity of Franklins Road, Randalls Lane and Dead Dog Lane may be impacted directly by this fire overnight, which is now burning in a north easterly direction. Three hundred and twenty CFA and DSE personnel are fighting the fire including 52 tankers and 3 bulldozers. CFA and DSE are confident the fire will be contained overnight. Update: 12.50am Urgent Threat Message – Rosewhite and Kancoona The communities of Rosewhite, Kancoona and Kancoona South should prepare for ember attack. A fire near Barwidgee and Mudgegona is moving south easterly towards the Rosewhite Valley, after having crossed the Myrtleford-Yackandandah Road. Update: 12.58am Urgent Threat Message Bracewell Fire (Bendigo) The Bracewell fire, burning at the edge of Bendigo has damaged a number of houses in the Long Gully and Sparrowhawk Estate area. The progress of the firefront has been largely contained within a perimeter along Marong Road, Eaglehawk Road, Bracewell Street and Upper California Gully Road. The fire is still burning inside that perimeter. Some homes to the north of Eaglehawk Road are still subject to ember attack. The relief centre at the Eaglehawk Leisure Centre has now been closed. The relief centre at the Kangaroo Flat Senior Citizens Centre is open. Anyone wishing to enquire whether relatives or friends affected by the fire have been registered at any of the relief centres, can call the State Enquiry Centre on 1800 727 077. There are significant numbers of firefighters working on the fire, including tanker crews from Ballarat and Swan Hill. Gas and electricity to the area has been cut off to prevent leaks. Update: 9.24pm Goulburn Valley Water situation due to the fires Goulburn Valley Water’s Managing Director has confirmed that the Kilmore Water Treatment Plant has been seriously damaged and Stage 4 water restrictions will need to come into effective immediately. Towns affected by Stage 4 water restrictions are Kilmore, Wandong and Heathcote Junction. Water usage is restricted to essential in-house use only. Obviously if people need to protect their homes from fires that goes without question, water can be used. Goulburn Valley Water is working with DSE and Yarra Valley Water to reinstate the water supply connection from Melbourne. The Broadford Water Treatment Plant is without power at the moment and Goulburn Valley Water is organising a temporary generator. Residents of Broadford and Waterford Park are requested that they use water for essential in-house use only until further notice. At this stage Goulburn Valley Water has no reports of damage to the water supply system in Alexandra, Eildon and Thornton. However, the Corporation requests that all customers in these towns conserve water wherever possible. Marysville and Buxton –like everyone we are waiting to gain access to these towns to assist the situation.. There will be a water quality problem in these towns and residents should assume that the water is not safe to drink. Victorians are aware of the support from fellow Australians and from people overseas who are aware of the tragedy. Many people are grieving and I’m looking for something to help ease some pain. I have had a few people ask me about the rights of photographers in Australia, I have these references from the Arts Law Centre of Australia. There is also a print out for every Australian photographer that they should carry around. I will put the link on here as well. The one rule i go by is to respect the person you are taking a photo of and people of authority. / . / Street Photographers Rights / . / Taking photographs in a public place / It is generally possible to take photographs in a public place without asking permission. This extends to taking photographs of buildings, sites and people. There are, however, some limitations. / . / Photographing people / . / There are no publicity or personality rights in Australia, and there is no right to privacy that protects a person’s image. Existing privacy laws are more concerned with storage and management of personal information and are of limited relevance to the present issue. / . / There is also currently no tort of invasion of privacy in Australia, but in ABC v Lenah Game Meats (2001) the High Court did not exclude the possibility that a tort of unjustified invasion of privacy may be established in the future. Based on this view, the Queensland District Court found in Grosse v Purvis (2003) that a tort of invasion of privacy had been made out on the facts and awarded the plaintiff damages. However, this case concerned a long history of harassment over many years and has limited application. As a result, taking photographs of people in public places is generally permitted. / . / Photographing people for a commercial purpose / . / If you are using your shots for a commercial purpose, such as for an advertising campaign, you should obtain a model release form signed by the subjects you are photographing to ensure you have authorisation to use their image to sell a product. See the Arts Law information sheet “Unauthorised Use of Your Image” for further information on defamation, passing off and trade practices law. A sample photographer’s model release form is also available on the Arts Law Centre of Australia website. / . / Photographing people on private property / . / There is no restriction on taking photographs of people on private property from public property. According to Victoria Park Racing and Recreation Grounds Co Ltd v Taylor (1937) there is no freedom from view, so people who are photographed on their property from a public location have no legal claim against you if what is captured in the photograph can be seen from the street. The same applies to photographs taken from private land when you have permission to take photographs. You should be careful that you are not being a nuisance and interfering with someone’s right to use and enjoy the land (see the case of Bathurst City Council v Saban (1985)). / . / Can taking photos be a criminal offence? / . / The Summary Offences Act 1988 (NSW) outlines a number of circumstances where a person’s privacy must be respected. For example, it is an offence punishable by a fine or imprisonment to photograph a person to provide sexual arousal or gratification if the person is undressed or engaged in a private act in circumstances where a reasonable person would reasonably expect to be afforded privacy, and he or she has not consented to being filmed. A private act includes using the toilet, bathing and engaging in sexual activities not ordinarily done in public. Similarly, the Surveillance Devices Act 1999 (Vic) and Surveillance Devices Act 1998 (WA) make it an offence to photograph a “private activity” without the consent of the subject. / . / The Crimes Act 1900 (NSW) also makes it an offence punishable with imprisonment to be in or near a building with intent to peep or pry upon another person. It is also an offence to stalk a person with the intention to cause fear of physical or mental harm. In serious cases, this may lead to an application for an apprehended violence order (AVO). / . / Also be aware that any photography construed as child pornography can result in criminal charges. For example, the Criminal Code 1899 (Qld) makes it an offence to take any “indecent” photograph of a child under the age of 16 without legitimate reason. You could face significant jail time, especially if the child is under 12. Similar provisions apply under the Criminal Code (NT), Criminal Code 1913 (WA), and the Criminal Law Consolidation Act 1935 (SA). / . / Photography of landmarks, buildings, monuments / . / There are provisions in the Copyright Act 1968 (Cth) that allow people to take and publish photographs of buildings, models of buildings, sculptures and other works of artistic craftsmanship without infringing copyright. See below for more detail. / . / However, photography is restricted in some areas by local councils or authorities. For example, the Sydney Harbour Foreshore Authority Regulation 2006 (NSW) prohibits a person from using a camera for a commercial purpose in a “public area” without the Authority’s permission. This applies to any part of the foreshore area that is vested in or managed by the Authority and the public can use, including Darling Harbour, Circular Quay, the Rocks and Luna Park. Non-compliance can result in a fine. A person who causes annoyance or inconvenience to other persons in a public area must leave the area when requested by a ranger or a police officer, who may remove the person with reasonable force if they fail to do so. Provided the ranger has warned you that failure to comply with the request is an offence, you can face a fine. For more details, contact the Sydney Foreshore Authority (http://www.shfa.nsw.gov.au). / . / Similar provisions and penalties exist for Sydney Olympic Park, prohibiting the use for commercial purposes of a camera and causing annoyance or inconvenience to other persons (Sydney Olympic Park Regulation 2001). Furthermore, an authorised person may confiscate a camera used in contravention of the Regulation if he or she has directed you to stop using it and you continue nonetheless, although force cannot be used. If your camera is confiscated, you should be issued a receipt indicating the date and time when it was taken. It must be returned to you or delivered to a public pound within 24 hours after confiscation. If delivered to a public pound, you must be notified in writing of the address. Also keep in mind that you must abide by the admission conditions on the entry ticket to events and sports grounds, including Telstra Stadium, Sydney Showground, Sydney SuperDome, Sydney Olympic Park Aquatic Centre. For more details, contact the Sydney Olympic Park (http://www.sydneyolympicpark.com.au). / . / Other penalties and provisions may exist for other areas in other States and Territories. / . / Restrictions may also be imposed by Local Councils on premises under their control, such as swimming pools. Following public concern and outrage due to “incidents” involving the photography of unwilling bathers on beaches, Councils were prompted to prohibit photography in these and similar areas. For example, you need a permit to commercially photograph any outdoor, publicly-owned space in Waverley, including beaches, parks, streets and cemeteries. It is therefore advisable to check with the Local Council whether there are restrictions on photography, however most restrictions seems to apply to commercial photography. / . / Government property / . / It is illegal to enter certain property belonging to the government such as railway yards, electrical power stations and military bases. Trespassing in these areas may lead to arrest and prosecution. For example, under the Defence (Special Undertakings) Act 1952 (Cth) it is an offence to gain unlawful entry into a “prohibited area” (including flying over it), punishable by imprisonment. The Minister can declare any area of land or water “prohibited” if it is necessary for Commonwealth defence. The same applies for taking a photograph of the area or anything in it. Merely possessing a camera while in a “prohibited area” can also result in imprisonment. Four Christian Pacifist activists were prosecuted under this Act for trespassing on the US Pine Gap military base in Australia and taking photographs in October 2006. / . / It is also illegal to photograph any defence installation in Australia under the Defence Act 1903 (Cth). Your photos, camera and film can be confiscated and destroyed, and you can face potential fines or imprisonment. You can even be arrested without a warrant. Always obey any warning signs displayed at such locations as you can be penalised even if you haven’t taken any photos, but have photography equipment in your possession. / . / If you are in doubt about a particular location, always check. / . / Photographing number plates / . / A number of photographers have asked Arts Law whether it is illegal to photograph car number plates on the street. While State and Commonwealth legislation permits police and roads authorities to use various Automatic Number Plate Recognition systems (like Safe-T-Cam) to monitor criminal activity such as speeding, the law does not prevent photography of car number plates. / . / You and the Police / . / Some photographers have been approached by the police while on the street taking photographs. The police may ask you to identify yourself. Generally, you do not have to comply, but there are some exceptions: / . / where you are in lawful custody, or the police suspect on reasonable grounds that you may assist in the investigation of an indictable offence (Law Enforcement (Powers and Responsibilities) Act 2002 (NSW)); or / where you are at the Sydney Olympic Park and are suspected on reasonable grounds of an offence against the Sydney Olympic Park Regulation 2001 (NSW). In this case, failure to comply is an offence only if you are first warned that such failure is an offence. / Under the Law Enforcement (Powers and Responsibilities) Act 2002 (NSW), the police do not have powers to stop, search and detain you without a warrant unless they suspect on reasonable grounds that: / . / you have in your possession or under your control anything stolen or unlawfully obtained, or to be used in connection with the commission of a relevant offence; or / . / you have in your possession or under your control in a public place a dangerous article that is being or was used in connection with the commission of a relevant offence. / For similar provisions in other states, see Police Powers and Responsibilities Act 2000 (Qld), Crimes (Custody and Investigations) Act 1988 (Vic) and Police Administration Act 2006 (NT). Do not forget the special powers that police and other authorised persons (such as rangers) may have in certain areas, as discussed above. / . / Obstruction and Public Order Offences / . / Setting up a tripod on a busy street and thereby impeding traffic is an example of an action that may amount to public obstruction. The Summary Offences Act 1988 (NSW) provides that it is an offence to prevent in any manner the free passage of a person, vehicle or vessel in a public place without reasonable excuse. Police have powers to arrest any person obstructing a public thoroughfare, although it is more likely that you would be asked to move on, and only arrested if you disobey. Police have powers to give a person in a public place reasonable directions if they believe on reasonable grounds that his or her behaviour or presence is obstructing another person or traffic, or constitutes harassment or intimidation of another person (Law Enforcement (Powers and Responsibilities) Act 2002 (NSW)). Failure to comply may be an offence punishable by a fine. / . / For similar provisions in other states, see Summary Offences Act 2005 (Qld), Summary Offences Act 2007 (NT), Summary Offences Act 1953 (SA), Summary Offences Act 1966 (Vic) and Criminal Code Act 1924 (Tas). / . / Photography and the Arts / . / Sculptures, monuments and artwork may be protected by copyright. Unless an exception applies, you need permission from the copyright owner of the work. Exceptions to this general rule are found in the Copyright Act. For example, photographing and publishing a photograph of a sculpture or work of artistic craftsmanship that is permanently situated in a public place, or in premises open to the public, does not infringe copyright (s 65). This does not apply to other public art, such as murals. If the public place is a gallery or museum, remember that your rights to photograph may be limited by the conditions of admission on your ticket. As previously discussed, you can also take pictures of buildings without infringing copyright. / . / Private Land / . / In order to access a privately owned space you need permission from the landowner, and he or she has the right to impose restrictions on photography. Therefore, you may only be allowed to photograph certain objects or locations. This type or restriction is common in many museums, galleries and sporting grounds, and may occur on land owned by Councils. Even where the landowner allows you to photograph, keep in mind that he or she may not be the copyright owner in artistic works you might be photographing. In this case, you need the permission of the author of the artwork as well. / . / If you do not have permission to be on privately owned property, you will be liable in trespass. Trespass is committed with the slightest interference with the land (damage to the land is not relevant). The owner may take legal action in trespass against you for taking photographs after gaining unauthorised entry (Lincoln Hunt v Willesee (1986)) or may be able to get an injunction to stop you using whatever footage you gathered while trespassing (ABC v Lenah Game Meats (2001)). The landowner may use reasonable force to remove you from their land. / . / Wildlife and National Parks / . / The Environment Protection and Biodiversity Conservation Regulations 2000 (Cth) includes provisions restricting the taking and use for commercial purposes of photographs in Commonwealth Reserves, including Kakadu National Park, Australian National Botanic Gardens, Christmas Island National Park, Norfolk Island National Park, Commonwealth Marine Parks and Reserves. To take photographs for commercial purposes in a Commonwealth Reserve, you should contact the reserve for a permit. Conditions may be imposed on the taking of the photographs. If in breach of the limitations, you may be fined and required to surrender all copies of the photographs and the camera used to take them. For further information contact the relevant Commonwealth Reserve. / . / Use/publication of photographs / . / Now that you have taken your photographs you need to be aware that their use or publication may also be illegal when carried out in a certain fashion. For example, the subject of a photograph may seek an injunction to stop the publication of photographs that are indecent, offensive or demeaning (Lincoln Hunt Australia v Willesee (1986) 4 NSWLR 456). / . / Defamation * / . / Defamation is the law that deals with injury to someone’s reputation. The unauthorised use of the photographs would need to lower the public’s estimation of the person portrayed, expose the person to hatred, contempt or ridicule, or cause him or her to be shunned or avoided. The unauthorised publication of the photograph in itself is not proof of defamation. Since defamation deals with reputation, the likelihood of an action in defamation will be higher the more famous the person photographed. / . / For a more detailed discussion, see the Arts Law information sheet “Defamation”. / . / The law of passing off and the Trade Practices Act / . / Complications arise if your photographs are used for a “commercial purpose” and you don’t have consent from the persons in the photograph. “Commercial purpose” involves using the photograph to sell something other than the photograph itself. So if you have taken a photo of someone on the street for an advertising campaign and it appears that the person is endorsing the product or service (when in fact they do not), you may be liable. / . / For a more detailed discussion, see the Arts Law information sheet “Unauthorised Use of Your Image”. / . / Photographs relating to Court proceedings / . / Photography in courts is restricted. The law of contempt of court also generally prohibits the publishing of any material, written or photographic, that is likely to prejudice the course of justice in a matter which is still before the courts. For example, in Attorney-General for the State of NSW v X (2000) the Sydney Morning Herald published an expose on organised crime, claiming that Mr Duong was “the top heroin distributor” and mentioned pending criminal charges against him. The Court of Appeal held that the article amounted to contempt of court because it implied Mr Duong was guilty. In coming to this decision, the judges were guided by the fact that the article was accompanied by two photos of Duong, each of which were “unusually large, in colour and of good quality”. / . / Copyright and Trademarks / . / You may be infringing copyright if you photograph the whole or a substantial part of a literary, musical, dramatic or artistic work, if the work is still protected by copyright. A registered trade mark owner has exclusive rights to use the trade mark and to authorise use of the trade mark in relation to goods/services for which the trade mark is registered. Taking a photograph of a trade mark should not involve trade mark use and is not trade mark infringement. As some of you may know, I’m a bit of a blur freak, and have used lensbabies for a couple of years. Last year I bought a couple of hand made bendy lenses from a lovely gentleman in the US, who is even more bendy mad than I! These lenses were made with bits and pieces, very low tech, and very difficult to use. I struggled with them for a few months, but then was distracted by something else shiny….can’t remember what now…anyway, to cut a long story short, I spoke to Matt Penfold about bendy lenses, since he said he might try and make one. I mentioned that I had a lensbaby travelling the country, currently with Adriana, but that I also had these Melholga lenses that he might be interested in. I posted one down to him, he did his Mcgyver thing on it, and all of a sudden I have an amazing little tool that works like a treat…..here are some images I shot today with the fabulous Miss Bertie Page These images are straight from the camera….unbelievably gorgeous, and although a little vignetted….I’m just blown away by them! Over 120,000 Australians have taken a stand against his flawed scheme that will do little more than divert funds away from where they’re needed most, and now he plans to bring legislation before Parliament next year.
