Copyright on graffiti is tricky. And I’m not taking about commissioned public murals or even commissioned pseudo-graffiti. Because even then the lines are blurry but at least then we have some legal grounds for one side to stand on. / You can’t prove you have a right copyright on graffiti unless you are willing to do the time/fine for defacing public property. And last time i checked no one can call copyright on a smashed window or a burnt car. From the research I did before I posted a certain shirt up on RB, it goes a bit like this: -Photographer taking pics of architecture/ruins owns the copyright to that image and all derivatives of that image. / -If the same photographer takes a detail of that image and morphs it into a completely different style of art work then they own the copyright to that derivative art work as well. Thats what the copyright law is telling me from what i have read. If i find out otherwise I will take action at that point in time. / So on the advice from RB Admin I will be keeping that shirt and the original image up on my page but I thought it would be an interesting discussion to put forward for the group. The idea of this series of photographic work touch on Imperfection of any types from physical to psychological state of mind. So it’s all about surrealism and fantasy.
