The Nerve of Some People....

I just have to let this out…………before I explode………….
I recently donated two paintings & to Arts Council 4 Youth

I think I got USED…AND …….ABUSED…………

I called the woman in charge of the organization to see how they fared in the silent auction….She told me they didn’t sell……….Oh Well……..so I asked if I could have them back and she said she didn’t know exactly where they were….“probably in the garage someplace”, she said……..
Then she told me that she will use them in a swap meet sale……some other time…
*NO……..NO….NO…………My art is not for SWAP MEETS
……..
I told her to have them back to me by the end of the week…….
I thought I was doing something Nice for the community and the school district…
What would you do……………????

I am not an artist but I have donated articles to charities and if they don’t sell (aren’t bid on) they get returned to the contributer. This woman you have met has just stolen your work. If she wishes to make a donation to the Arts Council 4 Youth on your behalf, she could provide you with the tax receipt. Otherwise it just seems like theft to me. How do you even know she put the articles out for auction?

  • You are exactly correct………….I don’t know………..if they went to auction at all…
They don’t show up on the list…………mahalo for your input……..aloha.

that is not good KJ! is there anyway you can talk to someone who is in a higher position in the organisation? they would not want to have a bad reputation as people will stop contributing…what did she say when you said you want them back…I hope she was going to find them for you! the nerve of some people indeed!

  • She sounded like a flighty ignorant person…………who couldn’t be bothered…….I know many people in the school district and believe me heads will fly………….mahalo for hearing me rant…………..aloha.,

I have a long post in my journal on donating art…I NEVER donate art…I got bitten once and so I give money instead…it never benefits the artist and even if sold, the work often ends up in somebody’s basement or garage…anyway if not sold it must be returned
Ask her for your art back and say you will be contacting the police if it is not returned by the next day…….believe me she knows where it is..

  • I have donated paintings in the past to many school organizations and never have I had this experience…
I am sure she knows where they are………..I will get them back………
We did get a receipt and I will be holding her accountable for this…
    always appreciate your support wahini…………..aloha……..

For anyone who is considering donating their works…I say don’t. but if you do, there should be: a contract signed stating the base price, where it would be hung, what happens if it is not sold and a tax receipt to the artist…there should be a bio of you posted near the art with your contact details and on the back of the art work should be written the same info…

  • I had my bio and contact details there and the crazy thing is it was returned to my house………..the lady left it on the door step and I didn’t notice it for a few dayz as we usually use the garage…………huh………..the nerve ……….

I HAVE DONE THIS BEFORE and got shafted,
“YOU” AS AN ARTIST OWN THE " LEGAL RIGHTS TO YOUR WORK", DONATION OR NOt, “PERIOD”
If they “DO NOT SELL” it’s they’re “OBLIGATION AND RESPONSIBILITY” to return any unsold work “UNDAMAGED DIRECTLY AFTER THE AUCTION”
AS stated by CARFAC and as a member MEMBER its important for ANY Artist to know of His/Hers rights, "EVEN AND REGUARDLESS IF YOU DO NOT HAVE LEGAL COPY RIGHTS. (you don’t have CARFAC there) google carfac anyway, it’s in EVERYONES BEST INTEREST.

Don’t ever stop helping youth, its just so wonderful. so tell them straight out and as bluntly that you are legally entitled to it back………
It’s what ARTISTS FOUGHT LONG AND HARD FOR……….

SO GO GET IT, the other thing is it’s damaging for the organization to do that, anything negitive can have a trickle down effect for any charity even loss of funding…………..
Keep me up to date, I’m interested.
    Good luck.
    Susan

  • Mahalo wahini Susan…………I appreciate your input and interest here.,……
I have spent a lifetime mentoring, coaching, educating youth………..this will not stop me..however this organization will be under scrutiny for awhile……..I am not done with them………….

Damn KJ, sorry that happened to you. Well I wouldn’t necessarily agree that you should never donate any artwork; although having gone through my similar experience a few years ago I learned that sometimes you can’t be too nice. Ever since that period I had to turn down a lot of things – I could given if I had the time to make contracts, do the research etc and find out if it’s trustworthy. Doesn’t donate to hurt to, let’s say, an organization that you are a proud member of – but from an outer source you don’t know well asking for an art donation for a cause; in the worst case best to avoid. But meanwhile, sometimes even reputable organizations are somewhat sleezy – sadly. Not all but it happens. Hope this gets sorted out – good luck.

  • mahalo wahini…………..for your input…..this organization is sponsored by the local school district…………I will get to the bottom of this…….I am not done with them……..I know many people in high places………..or is that high people in places……ha……..
