The actual surfer in this image i had posted in a surfing forum, hit my RB link in my signature and then tracked me down on my facebook link in my profile to buy the whole sequence that goes with the shot. I wasnt really sure how much to charge him but ended up sellinng a six shot sequence on CD for $100? I guess the only thing is once i sell the images to him i lose copyright over the images?

    Well done Simon!!
I thought copyright was just a given no matter what….
Maybe before you send them to him, add your signature or watermark to the images….

Hi Simon…not a copyright expert by any means. However, I think you can stipulate what his usage is permitted to be and still retain your copyright. EG. not for distribution, resale, reproduction etc etc etc….Well worth some quick research – I imagine Google will come up with some good information for you. And I think you undersold yourself too.

Excellent shot and congrats on the sale!!! He is obviously very impressed with you to track you down as he did.
My advise would be to get him to sign a release so you always own the copyright over the images.

This reminds me of when I did my first lot of portraiture work, I sent the girl the pics and she gave them to her boyfriend to copy and enlarge, I told her that its breaking copywrite and she said oh well its done now, I now only do portraits for family =0)

  • Simon Muirhead:

well i guess at this stage im not tooo worried about the pics getting out their..this guy knows a lot of people so i guess im happy to see it circulate:)

Congrats, Simon!!! I am so happy for you. I wouldn’t think you would lose your copyright unless you put that in writing. I would check. XXX

JoHadley is correct in saying that you can stipulate what the buyer will use the photographs for and for $100 I would definitely get something in writing to cover yourself. You can still retain rights to the photograph as long as you have something in writing saying so like Jo’s explaination. copyright laws can go one of two ways you can either sell a photograph for example to a large corporation that is going to use it for an advertising campagain where the corp. would pay you a lot more for the photograph and the rights…or you sell the photograph for a lot less with the written understanding that you still retain rights to the photograph and there are limitations to what the buyer can do with it! I agree with Jo also when saying you undersold yourself because you are a fabulous photographer but I understand where you are coming from what matters is if your happy with the outcome!! BIG CONGRATULATIONS!!! TERI~

WOW Simon you shouldn’t they say that if you have sold two or more photographs that you are considered a professional! Don’t ask me who “they” are but that is what I was told! :o) TERI~
