Looks like a Barred Owl from around where I live. Smoky Mountains. What kind of snake?

:-) I thought for sure it was going to consume the snake while facing us. It had it for some time and I am guessing the snake was not quite dead yet ( I have another shot facing me where/when the snake’s tongue is stll flicking the air for scents). It was pretty warm for the end of October but I was still surprised that Garter Snakes were still around…Lake Ontario keeps the surrounding land quite a bit warmer than where I live which is a 3 hour drive east of the island.
