The Orphan Works Bill is now on the move. If this bill passes in the USA, all American artists are going to get royally screwed. If it passes in the US, there will be more than likely a domino effect world wide. Just another way for the corporate greed to put the screws to us little folks.

Hey Dave and others! I’m taking a beating in the forum, but I can handle it. :-) I’m putting together a comprehensive article which will cover whether your work is published when it comes to copyright registration and application of statutory damages for infringement. I am waiting on the official word from the Copyright Office. But here’s a hint, it looks like if your work is posted to a web gallery (such as this one) your work has been published. Information Only Link
Why is this important? If your work is published, you may not be able to register your copyright in a collection of works, depending on the date of publication. Registration of a large collection of work saves you lots of money!!!
Also, published work may be subject to fair use which prevents you from filing a viable claim for infringement.
So stay tuned. I hope to complete the article in about 3 days. I will post in the writing section on my page and I will post it in a blog.
In the meantime, I will keep spreading the word.

Thank you so much Helen! You are an angel. We need the goods on the current situation and the prospective one. There definitely COULD be merits to a registered copyright, if it was handled with great respect to creators. There seems to be some notion that anyone can make art, so there is little value put on it. If anyone can make art, why do they want to use someone elses, that is my question.
But there is tremendous investment of energy, knowledge, training and skill in every single piece of art. And the act of publishing and marketing is an intense and costly endeavor in terms of both money and personal resources. That needs to be respected and recompensed. I don’t see other professions offering to work for free!
The synchronous combination of inspiration, talent, technical ability, motivation, ambition, timing, the alignment of the planets, etc to produce a piece of art happen only once. If missed, that image is forever lost. To bring all of these things together is nothing short of a miracle. For those who bring all of these things together and gift the world with the results, there should be respect and compensation given gladly.
If we acknowledge the wonder of our work and that of other artists, then the world at large will offer us that same wonder. Too often artist marginalize what they do and its contribution to humanity. If we will marginalize ourselves, we invite others to do the same. We need to stand proud and expect that from others. If we do this, the bill will see changes and our protections will improve.
So write letters, send emails, call and even visit your representative’s offices and sign petitions. Inform others, ask them to stand up and help present a united front to achieve the best protection we can get. If you see copyright infringement anywhere, speak up. If we don’t protect other people’s work, no one will protect ours!

The Orphan Works Bill is out of committee. Now is the time to zealously advocate for defeat of this bill. Please go to the Illustrators Partnership of America Legislative Action Center for more information and useful links to contact your Senators and Representatives.
This Bill will substantially limit your ability to recover financially if your work is infringed, even if your work was registered with the U.S. Copyright Office prior to infringement. So registration with the U.S. Copyright Office is a waste of your money if this Bill passes.
Important elements of the HOUSE BILL
Coerced Registration
• The Orphan Works Act would force artists to risk their lives’ work to subsidize the start-up ventures of private, profit making registries, using untested image recognition technology and untried business models. These models would inevitably favor the aggregation of images into corporate databases over the licensing of copyrights by the lone artists who create the art.
International Impact
• Because an unmarked picture cannot be sourced or dated, works by artists outside the U.S. will be as vulnerable to infringement in the U.S. as work by domestic artists.
• Presumably the Copyright Office and Congress expect non U.S. artists to register all their past and future art with the new hypothetical U.S. databases, or see their work exposed to commercial infringement under U.S. law.
• It is a violation of the Berne Convention for the Protection of Literary and Artistic Works for any country to impose registration on a rights holder as as a condition of protecting his copyright.
Please take this opportunity to protect your rights under the current copyright law by speaking out against this proposed legislation.
