The “Parody Defence” … that old chestnut seems to be doing the rounds again with members claiming that their use of a copyrighted property does not constitute copyright infringement … simply because its a parody.

I have said it before (link) … and I will say it again:

Parody is NOT an exemption to copyright.

 

Parody is only an argument that you can make in court as part of a greater argument for possible copyright exemption.

REDBUBBLE GETS SUED BY THE POKEMON COMPANY

It turns out that Pokemon claim that RedBubble are impacting their sales by “flagrantly” selling Pokemon related products.


Quotes from the SMH news article:

Pokemon alleges the names and the images of its characters, in whole or in part, are its copyright and Redbubble’s actions have crimped its sales in Australia.

“Redbubble has infringed Pokemon’s copyright …The infringement was flagrant,” according to Pokemon.

Fairfax Media identified hundreds of Pokemon-related products including T-shirts and hooded jumpers available for sale on Redbubble this week.

Pokemon alleges searches of Pokemon products on Redbubble’s platform turned up 43,528 sea

A large part of this misunderstanding comes from a confusion caused by the usage of the word “parody” itself.

To most of us, parody means to make fun of something. But in a legal sense that is closer to “satire”, and satire as you will shortly see has very little defence against copyright infringement.

I have had several discussions recently with members who have been struggling to understand the concept of “transformation” when it comes to copyright exemption.

The general understanding of transformation, amongst many RB members, goes something like this:

“If I change or modify an image then Fair Use law says that I am not infringing copyright because it is ‘transformative’”

HOW TO FIND THE “BUYER’S BOOTH”

 

I admit this one had me stumped for a while, until someone explained it to me…

At the top right of any page you will see the word SHOP with a little down arrow next to it. Logic tells you that this is a drop-down menu… but just like the ACTIVITY drop-down menu on our Homepage – it is also a text link.

  1. yeah go on, you know you wanna… click on it.
    1. This will take you to a very cool new page that kinda replaces the old EXPLORE & COMMUNITY pages.
  2. You can do all sorts of stuff in this new SHOP Page, but for now, scroll down towards the bottom of this new page.
  3. Near the end of the left column you will see the heading BUYER’S BOOTH, just click on the GO TO BUYER’S BOOTH link…

  1. Click on the shiny new red logo in the top left of any page.
    1. This will take you to the new-look Homepage / MyBubble Page.
  2. Down a bit on the right side you will see three text-links:
    1. FOUND
    2. FOLLOWING
    3. ACTIVITY
  3. ACTIVITY has two functions… it is a text-link and it activates a drop-down menu.
  4. Move your mouse over ACTIVITY and the drop-down menu appears [its magic!]
  5. From this drop-down menu you can select what sort of activity you want to view.
