copyright issues? by Brad McEvoy

Posted on February 09, 2010

Hi,
I have posted a few pictures from 2009 Sculpture by the Sea here on Redbubble but I have been ask to remove them from redbubble (I have). Below is part of the email I recieved. Has anyone else been contacted? I always though in Australia if someone or something was in the public it was free from copyright?

The concern reads:
"
Temporary public art such as the “Sculpture by the Sea” show is protected by copyright. Before publishing images of these works, permission must first be given by the original artist. The organisers of Sculpture by the Sea have been in contact with RedBubble and are happy to help artists contact the appropriate sculptors in order to obtain permission. (info@sculpturebythesea.com) Please de-publish this work until permission has been given by the copyright holder. Thank you for your understanding and cooperation"

Anyone got any advice?

Hey Brad, I contacted the sculptor of “Anna” to get his permission to show his work. It was all done by email and he graciously said ’No worries". I guess, it was just polite to let him know that you might be making money of an image of his sculpture. Although, in saying that not all public art is subject to this either. Going by the BM you have recieved, its clear that the artist wants permission first. I would contact them.

    Thanks.

Hi, got a comment from you and decided to check out your folio. This topic, although pretty old, has caught my eye. A friend of mine from RB has been photographing Sculpture by the Sea every years and last year was forced to remove his images also. But what he did this year was changing the name of the event to Statues Near the Ocean and no one bothered him and he even made some sales! I guess that’s all you have to do to go unnoticed :)
Check out his journal post and if you check out his folio (which is pretty large) you’ll be able to see the shots still there from this year’s event.
    Hope this helps :)

  • Brad McEvoy:

Thanks Evelina, not a bad idea, although I just couldn’t be bother with the event, this year. As I did try and contact the artist only about half got back to me and they didn’t seem to care. I think it was more about someone trying to create a job for them self. Cheers.

Hi Brad, this link will take you to the Australian Copyright Council. They are very good. Keep up with what they have to share with us all. Cut and paste it into your browser URL box at the top of your browser page.
